Napoli.Amato-Pagano clan: the Court of Cassation partially annuls with referral the sentence of conviction issued by the Court of Appeal of Naples against nine defendants.
The Supreme Court of Cassation - II criminal section, presided over by Piercamillo Davigo - has filed the sentence against some members of the clan accused of mafia-style association and association aimed at drug trafficking, partially annulling the sentence of conviction issued by the Court of Appeal of Naples. Although the Attorney General had requested the rejection of all appeals, the Court of Cassation annulled the sentence limited to the determination of the sentence against Raffaele Teatro, Giuseppe Imparato, (respectively sons-in-law of Raffaele Amato and Cesare Pagano, sentenced on appeal to 13 years and 6 months the first and 12 years the second), both defended by the lawyer Dario Vannetiello; Cosimo Marino, Giosuè Belgiorno born in 89-90, Attanasio Liguori, Carmine Caso, Gennaro Liguori, Alessandro De Cicco, Giuseppe Imparato, with referral to another section of the Court of Appeal of Naples.
The Capitoline Judges have rejected the appeals proposed by Raffaele Amato jr (20 years in prison), son of the female boss Rosaria Pagano, Carmine Cerrato, Giovanni Illiano, Mario Ferraiuolo, Carmine Esposito, Scognamiglio, for whom the sentences imposed have become irrevocable. It is necessary to wait for the filing of the motivation to understand what are the specific points of the annulment for each of those who will participate in the referral trial.
The expression "limited to the determination of the sentence" may include the identification of a lower basic sentence, the possible granting of mitigating circumstances, the amount of the sentence imposed for the continuous increases in crimes. In the referral judgment it will be a matter of verifying whether and by how much the sentence for those who have benefited from the cancellation will have to be reduced.
