Nocera, the trial for the Fosso Imperatore scandal ends with two convictions and 19 acquittals

Nocera Inferiore. Fosso Imperatore scandal: eight years after the raid by the Salerno Financial Police, the trial of the entrepreneurs accused of aggravated fraud, criminal conspiracy, false invoicing, and bankruptcy has concluded. Two convictions were handed down by the judges of the Court of Nocera Inferiore—Presiding Judge Domenico Diograzia, with Raffaella Caccavale and Franco Russo Guarro acting as assistant judges.

Two outstanding convictions: Luca Mantellassi, former president of the Florence Chamber of Commerce, who—in exchange for a four-year sentence—was given a two-year suspended prison sentence; and Padua-based entrepreneur Paolo Contini, acquitted of bankruptcy charges but who will, however, serve a four-year prison sentence.

Both defendants were sentenced to a 10-year ban from operating a business and will be barred from holding management positions in any company for the same period.
The trial that arose from the industrial disaster in the area of ​​the former southern cotton factories, redeveloped into an industrial hub through the Salerno Sviluppo Consortium, involved well-known Italian companies also famous abroad, such as Luigi Borrelli, known for its famous shirts and suits also worn by the Savoy family and in particular by Emanuele Filiberto at his wedding.

The judges acquitted all the defendants involved, businessmen and consultants, due to the statute of limitations or because the case did not exist or did not constitute a crime. Those accused of aggravated fraud—a statute-barred crime—and those accused of criminal conspiracy, a crime for which guilt was not proven, were exonerated from the trial.

Fabio Borrelli, the celebrity shirtmaker, Gaspare Pioggibico, Enrico Manzo, Umberto Navarra, Andrea Riccobene, Francesco Porcino, Massimo Pragliola, Antonio Chiantese, Paolo Laino, Luca Caprai, Enrico Formicola, Dario Salvi, Piero Tomassini, Nicola Salsano, Nicola Alfano and Massimo Severini were acquitted.

The only two companies held liable for administrative violations arising from the scam were Btr Italian Cachemire srl and Soltex srl, both of which were sentenced to pay a heavy fine and a six-month ban from advertising goods or services. The judges also ordered the confiscation of their assets.

The investigation launched by the Nocera Inferiore Public Prosecutor's Office concerned the reindustrialization of the Fosso Imperatore area, located between Nocera Inferiore and San Valentino Torio. This industrial incubator, primarily for textile industries, benefited from approximately €56 million in state funding.

The former president of the Chamber of Commerce of Florence Luca Mantellassi had been involved for having formed a company with Fabio Borrelli, owner of the famous Neapolitan tailor Luigi Borrelli, to produce high-quality products by merging their respective artisanal and industrial traditions. Mantellassi is famous for the production of high-quality footwear and clothing. The company Boma (Borrelli-Mantellassi) had received financing of approximately 2 million euros for the company in Fosso Imperatore.

At the conclusion of the first-instance trial (the reasons will be filed within 90 days), the judges also ordered the confiscation of assets for the convicted companies and released all the industrial warehouses of the other acquitted companies.
