Torture and hard prison, the union of the Criminal Chambers marching in front of the Poggioreale prison for the lack of respect for human rights

“The crime of torture exists in Italy, but the case is far from that provided for by the international conventions signed by Italy over 30 years ago”. This is what the UCPI, the Union of Italian Criminal Chambers, states in a note, commenting on the request of the UN Committee and recalling its “denunciation during the parliamentary process and immediately after the law came into force”, continuing to “express disapproval of what has been legislated”. The UCPI had pointed out that “the text qualifies the crime as ‘common’ and not as ‘proper’, thus separating it from the actions of public officials; the term ‘repeated’ had been deleted during the parliamentary process and replaced with ‘multiple conducts’; the crime does not exist ‘in the case of suffering resulting solely from the execution of legitimate measures depriving or limiting rights’ where the word ‘suffering’ together with ‘legitimate measures’ appears clearly in conflict; the criminal offence as described is difficult to apply, since the conditions set for punishability are complex if not impossible to verify”.
The Union of Criminal Chambers appeals "once again to the Government to immediately issue decrees on the reform of the penitentiary system: an urgency even more necessary after the recommendations of the UN. For the modification of the crime of torture, we will continue our battles, in the awareness of carrying out a just fight, to ensure that Italy is not continuously censored for the lack of respect for human rights". The dissent will be demonstrated on December 11 in all the Criminal Chambers and with the march from Naples to the Poggioreale prison, to protest against "the inefficiency of the Surveillance Court, the inhuman and degrading treatment of prisoners, the overcrowding of prisons and the excessive use of pre-trial detention".
