The Court of Cassation, II Criminal Section, presided over by Dr. Prestipino and with Dr. Di Pisa as rapporteur of the facts of the case, has put an end to the investigation by the District Anti-Mafia Directorate which brought the leaders of the group and dozens of affiliates of the Lo Russo clan to trial.
The appellants are twenty-nine: Barbato Maria, Borzacchiello Angela, Brillante Francesco, Cardillo Antonio, Centanni, Mario, Cerchio Salvatore, Cinicolo Francesco Saverio, Cinicolo Antonio, Culiersi Ciro, Culiersi Daniele, D'Abile Emanuel, D'Angelo Ignazio, Della Corte Giovanni, De Simini Antonio, La Hara Salvatore, Lo Russo Mario, Lo Russo Carlo, Luongo Pasquale, Madonna Gianluca, Marino Salvatore, Nappello Valerio, Nappello Carlo, Palumbo Gennaro, Parravano Alessandro, Polverino Pietro, Prota Emanuele, Silvestri Salvatore, Simonetti Pietro, Vitaliano Michele.
The charges concerned both mafia-type association and association for the purpose of massive drug trafficking. The indictment alleged that the powerful Lo Russo group had operated for a full fifteen years. The evidence acquired during the investigations thanks to wiretaps was enriched by the contribution offered to the investigators by the leaders of the association who later became collaborators of justice. The sentences imposed on 24.01.17/XNUMX/XNUMX by the Court of Appeal of Naples were severe, and became irrevocable following the declaration of inadmissibility of all the appeals filed by the numerous defense attorneys decided by the Court of Cassation. On the contrary, the Supreme Court, sharing the legal reasons formulated by the lawyers Dario Vannetiello and Annamaria Ziccardi, has annulled the sentence issued by the Court of Appeal of Naples regarding the confiscation that was imposed on the drug trafficker Salvatore La Hara, nicknamed “o pazzo”, from whom assets of considerable value were seized, represented by a property, bank and postal accounts as well as two cars. Thus, the hope for La Hara and his family to obtain his assets again has been reopened. The new trial on the subject will take place before another section of the Court of Appeal of Naples after the Court of Cassation makes known the reasons for which it has supported the theses of the lawyers Vannetiello and Ziccardi.
