Palmese & C. of Casal di Principe. The municipal administration of Sant'Antimo explains in a statement: "On September 01, 2017, the work began regularly, under the direction and control of the Municipal Technical Office, until, a few months later, on November 8, 2017, the Authority received a formal request from the winning company PRG for authorization to subcontract the works under tender. REFUSAL. This is the decision taken by the Technical Office Official, Engineer Claudio Valentino, in relation to the late request submitted by the PRG Company; in fact, during the tender process, the company in question, in point 5, letter f) of the application for admission to the tender, declared "I do not intend to subcontract". With particular reference to the Christmas lights, the Office instead specifically requested the PRG Company to supply the works by December 08, 2018. After the established deadline had elapsed to no avail, the SUAP Office The Authority received a communication from the company Criscuolo sas of Lusciano (CE) (and not Salerno) regarding the installation and switching on of the Christmas lights, of which, however, the Office had no knowledge. Subsequently, checks carried out on the city territory by the Local Police revealed that the personnel involved in the supply and installation of the lights were not employed by either the PRG or the Criscuolo company. Following this investigation, the PL sent the documents to the competent Judicial Authority. Furthermore, the Technical Office, represented by the Official, initiated the administrative procedure for the termination of the contract, for serious breach, against PRG sas, with the consequent enforcement of the deposit and notification to the ANAC for the inclusion of the company in the Computerized Records. This is the exact reconstruction of the administrative procedure. Any other different and fanciful representation, aimed at casting doubt on the correct operation of the Offices, will be the subject of a legal challenge, supported by objective findings and a referral to procedures that are impeccable in terms of management and legality. Finally, it is important to emphasize that, under the current regulatory framework, territorial origin, which in this case is Casal di Principe, does not constitute a reason for discrimination or a factor of advantage for any economic operator wishing to participate, or invited to do so, in public procurement procedures.
