Fake contracts to obtain and resell smartphones, 3 investigated

He activated contracts without the knowledge of his "clients." As part of an investigation coordinated by the Naples prosecutor's office, the Carabinieri in Ischia executed an order enforcing a precautionary measure prohibiting him from residing on the island against the owner of a mobile phone retailer. He had already been placed under house arrest on March 24, 2017, and was later sentenced to two years in prison for fraud. The man, along with two other suspects, faces charges of impersonation, improper use of credit cards, simulation of a crime, and false statements to a public official. The investigation began last January with a complaint against unknown persons filed by a man from Ischia who had received a bill from a mobile phone provider in the mail, which revealed that a service had been activated in his name without having requested it. The service was linked to a commercial offer that included the assignment of an expensive smartphone, never ordered or received, to be paid for in 30 monthly installments via credit card. Analysis of contractual documentation and witness statements revealed an agreement between the suspects to enter into numerous fictitious contracts involving unsuspecting individuals residing in Italy, including one in Switzerland. The contracts involved the purchase of latest-generation cell phones that no one ever ordered or received, which were then resold by the suspect or used by him or his relatives. In one instance, a false theft report was filed in Naples in which the man subject to the restraining order, providing a false identity, claimed his phone had been stolen. He then filed the report with an insurance company and obtained a new smartphone, which he then resold to an unsuspecting third party. To ensure the criminal scheme worked, at least initially, the three suspects, and in particular the telephone center manager, used credit cards registered to unsuspecting individuals and companies and offered the cell phones for sale through legitimate commercial networks, issuing proper receipts. Currently, the Carabinieri of the Ischia Company have identified five cases of phones being illicitly obtained and resold by the business. Further investigations are ongoing.
