Stamane, on behalf of the Public Prosecutor's Office of Santa Maria Capua Vetere, the Mondragone Guardia di Finanza Company, executed a preventive seizure order on assets worth 600 thousand euros, concerning the financial assets of a company based in Mondragone operating in the "supermarket management" sector, as well as the personal assets of the legal representative.
The ablative measure ordered by the GIP of the Court is based on the investigative investigations coordinated by the Public Prosecutor's Office with regard to the outcome of a tax audit carried out by the Guardia di Finanza, which made it possible to ascertain the failure to submit by the above-mentioned company the required tax returns, for income tax purposes, for the years from 2011 to 2014 and for VAT purposes, for the years 2012 and 2103, for a total of revenues subtracted from taxation of over 2 million Euros, with consequent evaded taxes for a total of 600 thousand Euros.
In consideration of the high evidentiary value of the elements collected during the inspection in the reconstruction of the actual volume of business illegally evaded from taxation, this Prosecutor's Office, in relation to the legislation that provides for the application of confiscation "for equivalent values" also for tax crimes, has submitted to the competent GIP the request for seizure of assets up to the amount of the evaded taxes, so as to prevent the consolidation of the illicit economic advantage resulting from the evasion perpetrated.
The investigating judge at the Court of Santa Maria Capua Vetere, adhering to the request made by the Public Prosecutor's Office, has therefore ordered the preventive seizure of the liquid assets held by the company and, equivalently, of the assets available to its legal representative.
During the execution of the measure, 3 real estate units in the municipality of Mondragone were placed under precautionary constraint, as well as the liquid assets present in current accounts, insurance policies, as well as the existing usufruct on company shares in favor of the administrator, for a total value estimated at approximately 350.000 euros.
