The Court of Cassation overturned the verdict declaring the manslaughter charge time-barred, remanding the case to the Salerno Court of Appeal, granting the defense's appeal on behalf of the family of Mario Venosa, a 45-year-old from San Cipriano d'Aversa, now living in Castellabate. The man was an employee of a waste collection company in the Cilento tourist resort. During his collection service, after dropping a bag into his truck, he suddenly slipped while driving off, hitting his head on the truck's foot pedal, and died instantly. The first-instance court sentenced the truck driver, in conjunction with the company owner, for manslaughter to one year and six months in prison, as well as an immediately enforceable provisional payment of approximately €300,000 to the family, who are plaintiffs in the case. However, the Salerno Court of Appeal erroneously ruled that the case should not proceed due to the statute of limitations, which had even expired before the first-instance ruling, and also revoked the provisional payment. The judges of the Supreme Court of Cassation, Section 4, definitively overturned the Salerno Court of Appeal's decision, upholding the appeal of the defense attorney Domenico Della Gatta, setting the statute of limitations at 2022 and confirming the provisional payment of €300,000.
