L'The VIII Section of the Court of Appeal of Naples, accepting the appeal of the lawyer Vittorio Fucci, also based on recent pronouncements of the Supreme Court of Cassation, the Constitutional Court and the European Court of Strasbourg, has revoked the sensational confiscation of the real estate, worth approximately one million euros, of Alfonso Masone, 80 years old, of Benevento which had been ordered by decree of the Prevention Measures Section of the Court of Benevento on 12 January 2015.
As you may recall, Masone was arrested in 2014 for the crime of aggravated usury, and was then released from prison, arrested again, and subsequently released from prison. In relation to the matter relating to the criminal proceedings, the Prevention Measures Section of the Court of Benevento also ordered the confiscation of the real estate. The Court of Appeal of Naples, however, was of a different opinion and annulled the decree of the Court of Benevento, revoking, with immediate effect, the confiscation of Masone's real estate.
