“On the anomalous administrative management of the Consorzio Idrico Terra di Lavoro, in May 2018 I had proceeded to draft a report to the Anti-Corruption Authority led by Raffaele Cantone because I had found several irregularities, and today, even after many months, I have received notification of the outcome of the supervisory procedure from the body that is about to issue sanctions against the Consortium's managers” declares the senator from Caserta Vilma Moronese (M5S) president of the environment commission of the Senate of the Republic who then adds “The Consortium falls within the scope of public administrations, and this characteristic means that it too is subject to the laws on transparency, which are monitored by ANAC. Among the numerous shortcomings in terms of transparency that I had found was the total absence of compensation for the governing bodies, but also for the management staff and much more that I promptly reported in the complaint.” Moronese continues “What I was informed by the President of the Anti-Corruption Authority, Dr. Raffaele Cantone, is that the proceedings following the complaint have been concluded and the Consortium has complied with some publication obligations, but at the same time the body has initiated a sanctioning procedure that could lead to the imposition of fines. up to € 10.000 for managers who omitted information that the law required to be made public”
The transparency rules were reorganized with a legislative decree in 2013 and then again in 2016, and these last changes introduced new elements so that ANAC could impose sanctions directly, thus art. 47 of legislative decree no. 33/2013 was modified "sanctions for violation of transparency obligations for specific cases" and the body led by Raffaele Cantone, gave itself a specific regulation that provides in the second part the procedures for initiating sanctions.
