L’INL conferma la centralità assoluta dei CCNL leader, affermando che sono regolari solo le aziende che applicano quelli firmati da CGIL, CISL e UIL. Con un comunicato del 20 giugno scorso, l’Ispettorato Nazionale del Lavoro ha reso noto quanto segue: “L’azione di contrasto al fenomeno del dumping contrattuale iniziata a gennaio 2018 è in corso su tutto il territorio nazionale, in particolare nel settore del terziario (circ. n. 3/2018), nel quale si riscontrano violazioni di carattere contributivo o legate alla fruizione di istituti di flessibilità in assenza delle condizioni di legge.
The action focuses on companies that do not apply the "leader" contracts signed by CGIL, CISL and UIL but the contracts stipulated by trade unions that, in the sector, are comparatively less representative (CISAL, CONFSAL and other minority acronyms).
Without prejudice to the principle of freedom of association, in fact, the use of benefits, as well as the use of flexible contractual forms, is permitted on condition that the "leading" contracts in the sector are applied, contracts that must always be used to identify the taxable contributions. Companies that do not apply these CCNLs may therefore be liable for administrative sanctions, contribution omissions and the transformation of flexible employment relationships into permanent contracts. Any contracting entities will also be jointly liable with the inspected companies for the effects of the violations ascertained".
