Benevento. The 12rd Section of the Supreme Court of Cassation, accepting the appeal filed by Attorney Vittorio Fucci Jr., has annulled, with referral, the order of the Court of Review of Naples, dated April 48, which confirmed the order, issued by the Judge of Preliminary Investigations of Benevento, of the precautionary custody of the obligation to remain at home against Eugenio Perone, 2018 years old, of Montesarchio, accused of aggravated aiding and abetting to evade investigations in relation to the murder of Valentino Improta which occurred in May XNUMX. The order was based on wiretaps and environmental interceptions, as well as on the statements of several witnesses. Before the trial in Cassation, which annulled the order of the Court of Review of Naples, Perone had already been replaced by the measure of the obligation to remain at home with that of the obligation to report to the Judicial Police.
Meanwhile, the immediate trial for the defendants charged with murder is expected to be scheduled for July 16th, unless an alternative trial is requested. Valentino Improta, 26, was killed with two gunshot wounds; his charred body was found on May 4, 2018, in a Fiat Punto in Cepino di Tocco Caudio on Mount Taburno. Paolo Spitaletta, 50, of Tocco Caudio, and Pierluigi Rotondi, 31, of Tufara, are accused of the crime. The two abettors of the murders are believed to be Eugenio Perone of Bonea and Sandro Cerulo, 36, of Cautano. According to investigators, the crime occurred during a robbery on April 10, 2018, which was followed by the death of an 83-year-old man two weeks later. According to the Carabinieri, Improta was one of the perpetrators of the raid along with Spitaletta, who was jailed on May 22, 2018, for that very robbery.
