Biagio Antonacci accused of plagiarism, Siae blocks the rights of the song 'Mio fratello'

Biagio Antonacci's song "Mio fratello" is under fire from SIAE (Italian Authors' Association), which has decided to suspend the distribution of royalties, deciding to "set aside" the "earned and accrued proceeds until the final resolution of the dispute" between the singer and musician Lenny de Luca. The latter, assisted by lawyers from Studio Lione Sarli, has filed a civil suit against the Milanese artist for alleged plagiarism, with a hearing scheduled for next week.
According to Lenny de Luca and his lawyers, there is a “clear coincidence” in the melody and in particular in the “chorus” between the song Mio fratello, released in 2017, and a piece entitled Sogno d'amore filed by the musician with Siae more than ten years ago. Lenny de Luca had already supported this in a formal notice sent, in October of last year, to the Milanese singer's record label to request recognition of the copyright. In the formal notice, moreover, the musician also explained that in 2005 he had created the song Sogno d'amore “proposed” also to Adriano Celentano and that he had “signed an exclusive contract with the company Editore ViaMeda srl-RadioRama, headed by the singer Eros Ramazzotti”, then filing the song again in 2012. And, after “a careful comparison” with Antonacci's single, he had found “the coincidence of 8 bars and in particular of the chorus”. The musician had said he was ready to file a civil lawsuit, which he then did with a writ of summons on February 18. At the same time, the lawyer Antonio Lione on April 3 asked Siae to set aside the “proceeds from the opera Mio fratello” in the meantime. The first hearing of the civil lawsuit is scheduled for next week in Milan. In the meantime, in recent weeks De Luca himself has also sent Ramazzotti and his record company, Viameda, an invitation to sign an assisted negotiation. He claims, in fact, that there are “numerous melodic correspondences” in the chorus and in “other musical sections” between the song Sogno d'Amore and the song Due respiri written by Eros Ramazzotti, Luca Chiaravalli and Saverio Grandi with which Chiara Galiazzo performed in the semi-final of the sixth edition of X-Factor.
