A patient at Frangipane Hospital in Ariano Irpino who sued the Avellino Local Health Authority after having his chemotherapy treatment postponed—albeit for just a few days—will not receive compensation. The Sixth Civil Section of the Court of Cassation upheld the ruling issued by the Benevento court, which had denied the man's right to compensation, stating that the conduct of the hospital's healthcare staff could not be considered "fault." The patient had attended the hospital to undergo chemotherapy, but due to the absence of a male nurse who was supposed to perform the procedure, the appointment was cancelled. Angered by this, the man contacted the municipal police, whom he met by chance outside the hospital. He returned to the hospital with them and obtained a new appointment. He then decided to file a claim for damages, which was rejected by the Ariano Irpino Justice of the Peace—who deemed the patient's experience "merely a nuisance"—and then by the Benevento Court, which noted that the health workers had urged the patient, once he returned with the municipal police, to immediately undergo treatment, which he declined. The treatment appointment was therefore scheduled for two days later, and in any case—the second-instance judge noted—the hospital staff immediately took action to find a "suitable replacement" for the missing nurse. The Supreme Court declared the man's appeal inadmissible: "Since there is no compensable damage," the order filed today states, "it is superfluous to discuss the existence or non-existence of negligent conduct by healthcare personnel." "Determining whether a certain unlawful conduct caused injury to health, whether such injury was serious or not, and whether or not it had trivial consequences," are, the Court of Cassation concludes, "factual assessments" reserved for the judges of the merits and not relevant to the legitimacy judgment.
