“With the approval of the law that gives the green light to building amnesty practices in the red zone, which M5S voted against, De Luca and his majority have put their seal on a text full of constitutional illegitimacy. A text inserted, among other things, at the last moment in a law on the reduction of the use of single-use plastic, in clear contrast with a ruling of the Council of State, which establishes, in an essential way, that it is not possible to build in the red zone of Vesuvius. The same ruling establishes that it is not possible to pardon properties, even if built before the imposition of the restriction, that are concretely in conflict with the restriction of absolute non-buildability imposed for the red zone by the national regulations of 1985 and by the regional ones defined by law 21 of 2003. At the basis of everything, the sacrosanct principle according to which there is a superior interest to protect, namely that of public safety”. "A regulatory change that, in addition to presenting profiles of illegitimacy for contrast with national regulations, does not solve the problem for the mayors. The municipalities involved will encounter the punctual opposition of the Superintendency, which will have no choice but to express unfavorable opinions on the existing constraints, as they have also been defined by the highest body of administrative justice".
