Acquitted "because the fact is not proven." Thus concluded the Milan trial in which Radical Party member Marco Cappato was charged with assisted suicide after accompanying 40-year-old Fabiano Antoniani, known by his stage name DJ Fabo, to his death in a Swiss clinic through assisted suicide. The professional and lay judges of the Milan Assize Court upheld the request for acquittal submitted by Deputy Prosecutor Tiziana Siciliano, based on the Constitutional Court ruling that the crime of assisted suicide is not punishable under certain conditions. The reading of the verdict was greeted with applause from those in attendance. Marco Cappato, who learned of his mother's death during the hearing, was absent and left the courtroom.
