The Supreme Court of Cassation, Fifth Criminal Section, in accepting the appeal filed by the lawyer Dario Vannetiello, has for the second time annulled the decree issued by the Court of Appeal of Naples which had declared the dangerousness of the boss Orazio De Paola, subjecting him to the preventive measure with the obligation to remain in residence.
A new trial will have to be held by the Neapolitan judges. With this decision, the heavy accusations against the boss, already convicted several times for mafia-style association, are crumbling more and more, having been considered by the investigators to be a leading element of the Pagnozzi clan.
For these reasons, the District Anti-Mafia Directorate had asked the Court of Avellino to limit De Paola's freedom for a period of five years. But thanks to the favorable outcome of the multiple decisions issued following the appeals filed by the defense, first in appeal and then in cassation, the duration inflicted was reduced to the minimum and identified in one year of special surveillance.
Now we await the outcome of the new trial which will establish whether Orazio De Paola, despite his criminal record, deserves to become a completely free man.
