Seizure of the Tav station of Afragola, the decision of the Review on January 14th. The documents of the investigation

On January 14, the judges of the Court of Appeal of Santa Maria Capua Vetere will have to decide on the appeal filed by the prosecutor of the Naples North Prosecutor's Office, Giovanni Corona, who is leading the investigation together with deputy prosecutor Domenico Airoma, regarding the seizure of the Afragola high-speed train station. The architectural jewel designed by Zaha Hadid does not in fact have the required tests. And in this latest line of investigation, after the one on the parking permits and the one on a dumping of waste in the area where the railway junction was built, Maurizio Gentile, CEO of Rete ferrovia italiana, is also under investigation with 8 other people. The investigation into the safety of the structure, the regularity of the projects and the tests, in fact had an initial stop months ago by the investigating judge of Naples North who did not find elements to grant the sealing of the area. According to investigators, the station was opened early, without a real test certificate, putting the safety of those who used it at risk, and this is why Gentile is facing the possibility of being charged with attempting to undermine transport safety. The investigations, according to what has been learned, indicate that the CEO in a meeting with Roberto Pagoni, Investment Director of RFI, also under investigation, and other technicians of the company, despite having learned that the certifications issued by Donato Inglese, test engineer for the Tav station, also under investigation, were unsuitable, failed to order the closure of the railway yard in self-protection because he had the objective of activating the node in the shortest possible time and keeping it in operation despite having, like everyone else, the inadequate professionalism adequate to evaluate the consequences deriving from the use of ideologically false certifications to give the go-ahead for the commissioning, the prosecutors write. In addition to RFI technical managers, the investigation also involves the former Democratic Party mayor of Afragola Domenico Tuccillo, who was a political point of reference for investigators to resolve problems in the construction of the high-speed railway. In a wiretap dated June 15, 2017, a few days after the inauguration, Tuccillo has a conversation with Pagone about the parking lot that was just seized because the company that was supposed to manage it did not have the necessary authorizations. The technician asks the politician to intervene with the prefect, Tuccillo seems perplexed but then he will take action and for this he is investigated for abuse of office. According to the hypothesis of the prosecutors, who delegated investigations to the Carabinieri, the station was inaugurated even though the works were still in progress because by 30 June 2017 Rete Ferroviaria Italiana had to send the annual report on the implementation status of the projects to the Ministry and communicate the performance objectives that, if achieved, would have triggered economic benefits based on an agreement; the railway hub was therefore considered completed with tests for the fictitious prosecutors. Some technicians, but not Gentile, are also accused of the crime of fraud in public supplies because there were construction elements such as unsuitable bolts. Donato Inglese, reconstructs the Naples North prosecutor's office, on May 26, 2017 issued a partial static suitability certificate with a self-limited effectiveness of 12 months from its issue date in which, for the investigators, he falsely attests that the conditions existed to declare the static suitability of the reinforced concrete and metal carpentry structures of the new station that was then inaugurated on June 6, 2017 by Prime Minister Paolo Gentiloni. In reality, Inglese had not carried out any of the activities typical of a tester and had certified that suitability by referring to a regulatory provision and issuing a certificate of only 4 pages on the same day that the documents were sent to him.
