La Strada Provinciale 335 è ormai diventata un incubo per gli automobilisti, a causa del tutor installato sul tratto che attraversa Marcianise. Recentemente però, il giudice di pace di Santa Maria Capua Vetere, Rodosindo Martone, ha annullato una multa per cartelloni e limite di velocità, notificata ad un’automobilista l’11 luglio scorso, dando speranza alle migliaia di persone che lamentano di aver subito lo stesso danno.
Vincenzo Ferrante, President of Konsumer Campania and Vice President of Konsumer Italia, stated on the case: “By virtue of what is written in the sentence, we can only reiterate our position: enough with the policy of making money without providing for serious prevention action. We ask for the immediate elimination of tutors installed in a totally illegal manner, an urgent meeting with the institutions responsible for a serious change of direction. Obviously we are not against respecting the limits, but they must be imposed legally and not in a merely vexatious way. Konsumer Campania remains available to defend consumer rights in every area and, with the Aversa and Agro Aversano desk, is committed to supporting this battle which, we reiterate, is not only legal. We will soon ask for access to the documents, to know exactly how much money is coming into the coffers of the Municipality thanks to the tutor.”
Lawyer Nico Nobis, legal representative of the Konsumer Aversa e Agro Aversano office, who has been dealing with the 'tutor trap' for some time, expressed himself as follows: "The road presents a clear contradiction in terms: in fact, the Municipality of Marcianise declares that it was not necessary to immediately contest the infringement - as required by law - justifying it with the fact that the SP335 is a main extra-urban road and therefore, being a fast-flowing road (like motorways) it represents the only exception to the general rule according to which, in order to carry out the deferred contestation of the fines, it is necessary for the road to be included in the appropriate prefectural decree. But then, absurdly, signs are fixed along the entire road indicating the speed limit of 60 km/h without meaning, which not even car navigators often detect, indicating the limit that should be there for this type of road, or 110 km/h! And then, I wonder, has a real trap been created for motorists? in the total absence of signs indicating an average speed control, is the whole thing arranged for the sole purpose of replenishing the municipal coffers without taking road safety into account in any way? Do we still want to continue to severely test the instinctive behavior of drivers, when they realize they are close to the tutor device? An investigation by the Prefecture and, perhaps, also by the Prosecutor's Office is urgently needed to put an end to this absurd harassment.”
Biagio Ciaramella, head of Aifvs and Konsumer Aversa and Agro Aversano, stated: “There are 62.000 reports notified, doing a few calculations we assume that the municipality and company collect almost 9 thousand euros per day, a real ATM to draw from continuously. We remain close to the many unfortunate people, who continue to contact us for support, and we will move with our lawyer to urge the prosecutor to investigate. It is time to clarify whether the tutor is legal and whether the road is up to standard”.
