Roccapiemonte. Following the fire that occurred on the evening of December 21, 2019 at Multitask, a packaging company located in via Piedirocca, and the Arpac surveys, the Mayor of Roccapiemonte, Carmine Pagano, issued the ordinance immediately ordering the assignment to a specialized company to proceed with the verification and analysis of every useful environmental element to safeguard public health identified in the Multiecoservice company with operational headquarters in Nocera Superiore. Below is the text of the ordinance:
GIVEN THAT:
on 21.12.2019/22/00, at approximately 5:26.12.2019 PM, a fire occurred at an industrial plant located in Via Piedirocca n. XNUMX/A and involved the intervention of Fire Brigade personnel, engaged in extinguishing operations that ended on the evening of XNUMX/XNUMX/XNUMX;
on 22.12.2019 the Mayor issued a specific contingent and urgent Ordinance, prot. no. 22418 of 22 December 2019, with which he ordered:
Citizens residing in Roccapiemonte are advised to keep all openings (doors and windows) of homes and commercial, industrial and service businesses closed, in order to prevent the possible passage of pollutants, including forced ventilation systems (air conditioners and air conditioning systems) until the alarm is over;
The ban, pending the acquisition of data from the competent bodies, on the collection and consumption of fruit and vegetables;
the evacuation, for precautionary reasons, of the homes adjacent to and bordering the warehouse affected by the fire;
on 23.12.2019 the Mayor issued a further contingent and urgent Ordinance, prot. no. 22479 of 23 December 2019, with which he ordered the owners of the structure to immediately comply with the following requirements aimed at reducing the risks of dispersion and contamination towards the outside of the site contained in the Service Report of 22.12.2019 by ARPAC staff, certified to this Body with prot. gen. no. 22435 of 23.12.2019:
removal of the pile of semi-burned material on the yard in accordance with current legislation and disposal in accordance with current legislation; 1
extraction of fire-fighting water by tanker and disposal as liquid waste, such as rainwater falling on the yards, until they are completely cleaned; 3. removal of water from the underground floors, accumulated by gravity, in order to prevent infiltration into the subsoil.
On 30.12.2019/22658/30.12.2019, the Mayor, together with the UTC Manager, issued a further contingent and urgent Ordinance prot. no. 11 of 13/53100/92034720521 with which he ordered the uninhabitability of the building used as an industrial factory, affected by the fire, consisting of prefabricated elements, located in Via Piedirocca, prohibiting its use until the conditions noted persist and ordering, for the reasons set out in the introduction and which are intended to be expressly recalled, the company: MONTE DEI PASCHI DI SIENA LEASING E FACTORING – BANCA PER I SERVIZI FINANZIARI ALLE IMPRESE SPA with registered office and general management in Via A.Moro, 01.11.1955/XNUMX – XNUMX SIENA – Tax code and no. registration in the Companies Register of Arezzo – Siena: XNUMX – pec MPSLF@POSTACERT.GRUPPO.MPS.IT – Chairman of the Board of Directors Mr. Pistolesi Oscar Antonio Giuseppe born on XNUMX in Milan, owner of the real estate and anyone, in any capacity, who occupies the aforementioned properties, not to use the premises until normal safety conditions are restored and until the revocation of this ordinance, upon presentation of a specific building application and related project for the safety and re-roofing of the building damaged by the fire, in full compliance with the provisions of current legislation;
SEEN:
the communication on the ARPAC website dated 31.12.2019/XNUMX/XNUMX which states verbatim that:
“…M10 and IPA
The results show that the average daily PM10 concentration value found, equal to 56 μg/m50 (micrograms per cubic meter), is higher than the daily limit value (155 μg/m2010 indicated in Legislative Decree 35/XNUMX), which should not be exceeded more than XNUMX times per year.
As regards PAHs (polycyclic aromatic hydrocarbons), the detected value of 2,04 ng/m1 (nanograms per cubic metre) is higher than the average annual value indicated by the legislation as the target value for Benzo (a) Pyrene alone (22 ng/m23), with an increasing trend compared to the sampling of XNUMX-XNUMX December, which has already been reported.
These sampling activities were carried out for twenty-four hours between 23 and 24 December in the absence of rain.
Dioxins and furans
The analytical results, referring to a twenty-four hour sampling period between 27 and 28 December, highlight a concentration value equal to 0,20 expressed in pg/Nmc IT.EQ (picograms per cubic metre in terms of total equivalent toxicity), higher than the reference value proposed by the Laender Ausschuss fuer Immissionsschutz and generally used by the scientific community, equal to 0,15 pg/Nmc.
Based on the results found, the Agency is continuing its monitoring activities in these days: further results will be released as soon as they are available”;
CONSIDERING it is therefore necessary, following the above, to act urgently to safeguard public and private safety, immediately arranging for the assignment of a specialized company to proceed with the verification and analysis of every useful element of an environmental nature to safeguard public health identified in the Multiecoservice company with operational headquarters in Nocera Superiore at Via Roma n. 12 VAT number 01242681219 considering that the ARPAC communication of 31.12.2019/27.12.2019/XNUMX differs from the ARPAC communication of XNUMX/XNUMX/XNUMX;
CONSIDERING that the adoption of this ordinance is justified and legitimised by the occurrence of a supervening situation which has an exceptional nature (fire), for which it is necessary to act urgently;
RECALLING art. 54 paragraph 4 of Legislative Decree 267/2000 which establishes that the Mayor, as a Government Official, adopts with a reasoned act measures, including contingent and urgent ones in compliance with the general principles of the system, in order to prevent and eliminate serious dangers that threaten public and private safety or urban security, and that such measures must be communicated to the prefect also for the purpose of preparing the tools deemed necessary for their implementation;
HAS
the assignment to a specialized company for the verification and analysis of every useful element of an environmental nature to safeguard public health identified in the Multiecoservice company with operational headquarters in Nocera Superiore at Via Roma n. 12 PIVA 01242681219 considering that the ARPAC communication of 31.12.2019 differs from the ARPAC communication of 27.12.2019.
