The situation of the 24-year-old Roman woman who, the other night, got behind the wheel completely drunk (in fact, she tested positive to the breathalyzer test administered by the Carabinieri with an alcohol level of 1,4 g/l) and, on the outskirts of Rome (Guidonia), hit a 57-year-old pedestrian who was guilty only of being in the wrong place at the wrong time, is worsening. The victim is Stefano Alberini born in Caivano in the Province of Naples on 4 October 1962, resident in Rome, pastry chef who, initially hospitalized in the emergency room of Tivoli, was transported to the Policlinico where he died today due to the serious injuries sustained (documentation attached). The woman had initially been investigated at large for drunk driving and serious personal injury but now the investigation carried out by the Public Prosecutor's Office is for road homicide ( art. 589 bis cp which provides for imprisonment from 2 to 18 years). The Magistrate may soon order a precautionary measure against the girl. The driver had a blood alcohol level much higher than the permitted level. The Law now establishes the limit of 0,5 grams/litre of alcohol in the blood (for minors under 21 and for new drivers even a “zero” level). Unfortunately, however, our Legislator, while rightly has heavily increased the penalties for manslaughter (2-18 years of imprisonment), has not done the same for simple drunk driving. In fact, with a blood alcohol level higher than 0,5 grams/litre only administrative sanctions are foreseen, while if the level is over 0,8 grams/litre driving becomes a crime, but a misdemeanor crime with a very short statute of limitations (four years).Unfortunately, in none of these cases has the definitive revocation of the driving license been foreseen. Some relatives of the victims, represented by the Giustitalia Association which also assists the Roman girl injured in Trentino and Paolo Canavese, the pensioner killed two days ago in Sardinia, ask that a decisive step forward be taken by our Legislator and that the the principle of lifelong revocation of the driving licence (so-called “life sentence” of the driving licence) for anyone who causes a road accident while driving under the influence of alcohol.
