The evidence emerging from the telephone conversations intercepted by the Naples DDA, as part of another investigation, could not be included in the investigation by the Torre Annunziata Prosecutor's Office and does not constitute serious evidence of guilt against Forza Italia parliamentarians Luigi Cesaro (defended by lawyers Giuseppe De Angelis and Giovanni Vignola) and Antonio Pentangelo (defended by lawyer Antonio Cesarano).
On May 15, the investigating judge, assuming the crime of corruption, requested house arrest against them. This was established by the Court of Appeal of Naples, which on June 16 annulled the precautionary measures issued against the two Forza Italia parliamentarians.
The Review also carried out the so-called "resistance test", in order to establish the self-sufficiency of the elements collected by the investigation of the Torre Annunziata Investigating Office regarding the project for the reconversion of the production complex. ex Cirio of Castellammare di Stabia (electoral meetings, night meetings and exchanges of documents).
