The judges of the Second Criminal Section of Rome have sentenced the judge of the Council of State Nicola Russo (now suspended) to 11 years in prison for the accusation of corruption in judicial acts for having rigged at least three sentences. The prosecutor had requested a sentence of 7 and a half years. The judges also declared Russo's relationship with the public administration terminated and ordered compensation of 100 thousand euros in favor of the Presidency of the Council, which joined as a civil party, and over 64 thousand in favor of the judicial administration as pecuniary compensation. The investigation is based on the statements of the lawyer Pietro Amara according to which Russo, arrested in February 2019, obtained from him approximately 80 thousand euros (and another 60 thousand promised), to adjust sentences of three proceedings before the Council of State.
The investigation, which led to Russo's arrest in February 2019, was triggered by statements made by lawyer Piero Amara to magistrates, to whom he reported that he had given the judge 80 thousand euros, promising another 60 thousand to have three sentences 'fixed'. In the same proceeding, in July 2019, the former president of the Sicilian Council of Administrative Justice Raffaele Maria De Lipsis and the former magistrate of the Court of Auditors Luigi Pietro Maria Caruso, also accused of corruption in judicial acts, pleaded guilty to a 2 and a half year sentence. For a third defendant, the now suspended deputy of the Sicilian regional assembly Giuseppe Gennuso, the preliminary hearing judge Costantino De Robbio downgraded the charge to influence peddling, setting the sentence at one year and two months.
