The new DPCM arrives before the lock down: from restaurants, to sports, to visits. ALL THE PROHIBITIONS

RESTAURANTS STOP AT 24 AM, AT 21 PM WITHOUT TABLE SERVICE

Bar, ristoranti, pub, gelaterie e tutte le attività di ristorazione potranno restare aperti fino alle 24 o fino alle 21 se non c’è servizio al tavolo. E’ quanto si legge nell’ultima versione del Dpcm, stilato al termine della riunione della cabina di regia con le Regioni e che LaPresse ha potuto visionare. L’apertura è consentita se “le Regioni e le Province autonome abbiano preventivamente accertato la compatibilità dello svolgimento delle suddette attività con l’andamento della situazione epidemiologica nei propri territori e che individuino i protocolli o le linee guida applicabili idonei a prevenire o ridurre il rischio di contagio nel settore di riferimento o in settori analoghi”. Consentite le attività “delle mense e del catering continuativo, la ristorazione con consegna a domicilio nel rispetto delle norme igienico-sanitarie sia per l’attività di confezionamento che di trasporto, nonché la ristorazione con asporto, con divieto di consumazione sul posto o nelle adiacenze dopo le ore 21 e fermo restando l’obbligo di rispettare la distanza di sicurezza interpersonale di almeno un metro”.

MASK MANDATORY, RECOMMENDED AT HOME IF THERE ARE NON-COHABITANTS

“For the purpose of containing the spread of the Covid-19 virus, it is mandatory throughout the national territory to always have respiratory protection devices with you, as well as to wear them in indoor places other than private homes and in all outdoor places except in cases where, due to the characteristics of the places or the actual circumstances, the condition of isolation from non-cohabiting people is continuously guaranteed, and in any case with the exception of the anti-contagion protocols and guidelines provided for economic, productive, administrative and social activities, as well as the guidelines for the consumption of food and drinks, and with the exclusion of the aforementioned obligations: a) for individuals who are carrying out sports activities; b) for children under the age of six; c) for individuals with pathologies or disabilities incompatible with the use of a mask, as well as for those who are incompatible with the use of a mask in order to interact with the aforementioned”. This is stated in the draft of the Prime Ministerial Decree being studied by the government. “The use of respiratory protection devices is strongly recommended even inside private homes in the presence of non-cohabiting people,” it reads.

 'NO PATIENTS ACCOMPANYING THE EMERGENCY ROOM'

“Patients' companions are prohibited from remaining in the waiting rooms of emergency and admission departments and emergency rooms (DEA/PS), unless otherwise specifically indicated by the healthcare personnel in charge”. This is stated in Article 1 of the draft anti-Covid Dpcm.

'MANDATORY INTERPERSONAL DISTANCE OF AT LEAST ONE METER'

“It is mandatory to maintain a safety distance of at least one meter between people.” This is stated in the draft of the Prime Ministerial Decree that will be approved by the government.

'LIMITED ACCESS TO RELATIVES AND VISITORS IN RSA'

“Access by relatives and visitors to hospitality and long-term care facilities, assisted living facilities (RSA), hospices, rehabilitation facilities and residential facilities for the elderly, whether self-sufficient or not, is limited to the cases indicated by the health management of the facility, which is required to adopt the necessary measures to prevent possible transmission of infection”. This is provided for in the draft of the anti-Covid Dpcm.

 'SYMPTOMATIC CASES IN PRISON ISOLATED FROM OTHER PRISONERS'

“Symptomatic cases of new admissions are placed in isolation from other inmates”. This is established in Article 1 of the draft of the new anti-Covid Dpcm. “Taking into account the indications provided by the Ministry of Health, in agreement with the coordinator of interventions to overcome the coronavirus emergency – it also states -, the territorial branches of the National Health Service ensure the Ministry of Justice adequate support for the containment of the spread of the Covid-19 contagion, also through adequate measures suitable to guarantee, according to the health protocols developed by the General Directorate of Health Prevention of the Ministry of Health, new admissions to penal institutions and juvenile penal institutions”.

AT HOME WITH A 37,5° FEVER AND NO CROWDS 

“In order to combat and contain the spread of the Covid-19 virus throughout the national territory, the following measures apply: a) subjects with respiratory infection characterized by fever (higher than 37,5°) must remain at home, contacting their doctor; b) public access to parks, villas and public gardens is subject to strict compliance with the ban on gatherings referred to in art. 1, paragraph 8, first period, of Legislative Decree 16 May 2020, no. 33, as well as the interpersonal safety distance of at least one meter; access by minors, even together with family members or other persons habitually living with them or responsible for their care, to play areas within parks, villas and public gardens, to carry out outdoor play or recreational activities in compliance with the guidelines of the Department for Family Policies”. This is stated in the draft of the Prime Ministerial Decree that will be approved by the government.

 EDUCATIONAL TRIPS AND GUIDED TOURS SUSPENDED

The Prime Ministerial Decree currently being examined by the regions provides that "educational trips, exchange or twinning initiatives, guided visits and educational outings of any kind, planned by educational institutions of all levels, are suspended, with the exception of activities related to transversal skills and orientation courses, as well as internship activities pursuant to the decree of the Minister of Education, University and Research of 10 September 2010, no. 249, to be carried out in cases where it is possible to guarantee compliance with current health and safety regulations".

IN DPCM THERE IS NO DISTANCE LEARNING

Distance learning is not provided for in the Prime Ministerial Decree that the government is working on, not even for high schools. This is what government sources explain. Some Regions had put forward the proposal to return to DAD for high schools today.

'OUTDOOR SPORTS ALLOWED WITH A SAFE DISTANCE OF 2 METERS' 

“It is permitted to carry out sports or physical activity outdoors, even in equipped areas and public parks, where accessible, provided that the interpersonal safety distance of at least two meters is respected for sports activities and at least one meter for any other activity unless the presence of an accompanying person is necessary for minors or people who are not completely self-sufficient”. This is stated in the draft of the Prime Ministerial Decree that will be approved by the government.

'STORE ENTRIES DELAYED, LEFT ONLY TIME FOR SHOPPING'

Distancing of at least one meter and staggered entrances to stores, so that customers remain inside for the time strictly necessary for shopping. This is what Article 1 of the draft of the new anti-Covid Dpcm provides. “Retail commercial activities – it states – are carried out on condition that, in addition to the interpersonal distance of at least one meter, entrances are staggered and that people are prevented from staying inside the premises longer than the time necessary for purchasing goods; the aforementioned activities must be carried out in compliance with the contents of protocols or guidelines suitable for preventing or reducing the risk of contagion in the reference sector or in similar areas, adopted by the Regions or by the Conference of Regions and Autonomous Provinces in compliance with the principles contained in the national protocols or guidelines and in any case in line with the criteria set out in Annex 10. The application of the measures set out in Annex 11 is also recommended”.

'YES TO CANTEENS AND CATERING, HOME DELIVERY AND TAKE-AWAY' 

Yes to canteens and catering, home delivery and takeaway. This is provided for in the draft of the new anti-Covid Dpcm. “The activities of canteens and continuous catering on a contractual basis continue to be permitted, which guarantee the interpersonal safety distance of at least one meter, within the limits and under the conditions referred to in the first period – it states – Catering with home delivery is also permitted in compliance with the hygiene and health regulations for both packaging and transport, as well as catering with takeaway, with a ban on consumption on site or in the vicinity after 21 pm and without prejudice to the obligation to respect the interpersonal safety distance of at least one meter”.

 FOR ATHLETES FROM ABROAD MOLECULAR OR ANTIGEN TEST BEFORE ARRIVAL 

“In order to allow the regular holding of national and international sports competitions organized on Italian territory by national and international sports federations, associated sports disciplines or sports promotion bodies recognized by CONI or CIP, which include the participation of athletes, technicians, judges and race commissioners, and companions from countries for which entry into Italy is prohibited or for which quarantine is required, the latter, before entering Italy, must have taken a molecular or antigen test to verify their state of health, the result of which must be indicated in the declaration referred to in art. 5, paragraph 1, and verified by the carrier pursuant to art. 7. This test must not be older than 72 hours from arrival in Italy and the subjects concerned, in order to be authorized to enter Italy, must be in possession of the result certifying that they are negative and reporting the personal data of the person subjected to the test for any checks. In the event of a negative swab result, the interested parties are authorized to take part in the international sports competition on Italian territory, in accordance with the specific protocol adopted by the sports body organizing the event”. This is stated in the draft of the Prime Ministerial Decree that will be approved by the government.

'YES' PER PERSON SERVICES IF FOR REGIONS COMPATIBLE WITH EPIDEMIC STATUS'

“Activities related to personal services are permitted provided that the Regions and Autonomous Provinces have previously ascertained the compatibility of carrying out the aforementioned activities with the progress of the epidemiological situation in their territories and that they identify the applicable protocols or guidelines suitable for preventing or reducing the risk of contagion in the reference sector or in similar sectors”. This is provided for in the draft of the new anti-Covid Dpcm. “Said protocols or guidelines – continues the draft – are adopted by the regions or by the Conference of Regions and Autonomous Provinces in compliance with the principles contained in the national protocols or guidelines and in any case in coherence with the criteria set out in Annex 10; the carrying out of activities related to personal services already permitted on the basis of the Prime Ministerial Decree of 26 April 2020 remains unchanged”.

'THEATRE, CINEMA AND CONCERTS MAXIMUM 1000 PEOPLE OUTDOORS AND 200 INDOORS' 

"Performances open to the public in theaters, concert halls, cinemas and other spaces, including outdoors, are held with pre-assigned and spaced seats and provided that interpersonal distance of at least one meter is ensured for both staff and spectators who do not habitually live together, with a maximum number of 1000 spectators for outdoor performances and 200 spectators for performances in closed places, for each individual room. The activities must be carried out in compliance with the contents of protocols or guidelines suitable for preventing or reducing the risk of contagion in the reference sector or in similar areas, adopted by the Regions or by the Conference of Regions and Autonomous Provinces in compliance with the principles contained in the national protocols or guidelines and in any case in line with the criteria set out in Annex 10. Events that involve gatherings in closed or open spaces remain suspended when it is not possible to ensure compliance with the conditions set out in this letter. The regions and autonomous provinces, in relation to the progress of the epidemiological situation in their territories, may establish, in agreement with the Minister of Health, a different maximum number of spectators in consideration of the size and characteristics of the places; with reference to the maximum number of spectators for non-outdoor shows in theaters, concert halls, cinemas or other closed places, the ordinances already adopted by the regions and autonomous provinces are in any case safeguarded”. This is stated in the draft of the Prime Ministerial Decree that will be approved by the government.

'NO PARTIES, POSSIBLE THOSE AFTER CEREMONIES WITH MAXIMUM 30 PEOPLE'

“Activities taking place in dance halls and discos and similar venues, indoors or outdoors, remain suspended. Parties in all indoor and outdoor venues are prohibited. Parties following civil or religious ceremonies may be held with a maximum of 30 people in compliance with the protocols and guidelines in force”. This is stated in the draft of the Prime Ministerial Decree that will be approved by the government.

CORONVIRUS. DRAFT DPCM: SMART WORKING RECOMMENDED, INCENTIVISE HOLIDAYS

With regard to professional activities, the anti-covid Prime Ministerial Decree "recommends that they also be implemented through agile working methods, where they can be carried out at home or remotely and that paid holidays and leave for employees as well as other tools provided for by collective bargaining be encouraged".

'ACCESS TO PLACES OF WORSHIP WITHOUT CROWDS' 

“Access to places of worship takes place with organizational measures that avoid gatherings of people, taking into account the size and characteristics of the places, and that guarantee visitors the possibility of respecting the distance between them of at least one meter”. This is stated in the draft of the Prime Ministerial Decree that will be approved by the government. “Religious functions with the participation of people are held in compliance with the protocols signed by the Government and the respective confessions”, the text underlines.

 'MUSEUMS OPEN WITH LIMITED ENTRANCES AVOIDING CROWDS' 

“The service of opening to the public of museums and other cultural institutions and places referred to in art. 101 of the Cultural Heritage and Landscape Code, referred to in Legislative Decree no. 22 of 2004 January 42, is ensured on condition that said institutions and places, taking into account the size and characteristics of the premises open to the public, as well as the flow of visitors (more or less than 100.000 per year), guarantee limited methods of use or in any case such as to avoid gatherings of people and to allow visitors to respect the distance between them of at least one meter. The service is organized taking into account the protocols or guidelines adopted by the Regions or by the Conference of the Regions and Autonomous Provinces. The administrations and entities managing museums and other cultural institutions and places may identify specific organizational, prevention and protection measures, as well as worker protection measures, taking into account the characteristics of the places and the activities carried out; the effectiveness of the regulatory provisions referred to in article 4, paragraph 2, second period, of the decree of the Minister for Cultural and Environmental Heritage of 11 December 1997, n. 507, which provides for free access to all state institutes and places of culture on the first Sunday of the month, remains suspended". This is stated in the draft of the Prime Ministerial Decree that will be approved by the government.

 'SANITIFICATION OF WORKPLACES, EVEN USING SHOCK ABSORBERS

To deal with the coronavirus emergency, the draft of the new anti-Covid Dpcm regarding professional activities calls for “anti-contagion safety protocols to be adopted” and the adoption of personal protective equipment “where it is not possible to respect the interpersonal distance of at least one meter as the main containment measure”. It also calls for “workplace sanitization operations to be encouraged, also using forms of social safety nets for this purpose”.

'FROM SCHOOLS ALL USEFUL MEASURES, FOR CASE MANAGEMENT ISS INDICATIONS'

“Schools continue to prepare all measures useful for the start and regular conduct of the 2020/2021 school year, also on the basis of the operational indications for the management of cases and outbreaks of Sars-COV-2, developed by the Istituto Superiore di Sanità”. This is what the draft of the anti-Covid Dpcm provides. Among other things, the draft states that “meetings of the collegiate bodies of schools and educational institutions of all levels can be held in person or remotely based on the possibility of ensuring physical distancing and, consequently, the safety of the personnel summoned”. The management bodies “will ensure the cleanliness of the environments and the administrative and accounting obligations concerning educational services for children”. “The owner of the property may authorize, in coordination with the educational institutions, the managing body to use its spaces for the organization and carrying out of recreational, educational and recreational activities, which are neither scholastic nor formal, without prejudice to the activities of the educational institutions themselves. The activities must be carried out with the assistance of qualified personnel, and with the obligation on the part of the managers to adopt specific safety protocols in compliance with the guidelines in Annex 8 and to carry out the necessary cleaning and sanitization activities. Under the same conditions, public or private sports centers may also be used.”
