This is what the Campania guarantor of prisoners Samuele Ciambriello says regarding the case of Giovanni Marandino: 83 years old, from Salerno, detained in the Poggioreale prison since last February 3 because he is accused of usury and the illegal exercise of financial activities. According to Ciambriello, the elderly man suffers from various pathologies and last February 22 "he was taken ill and was transported to the Pellegrini hospital, where he remained under observation for the whole night and on Sunday he returned to prison".

“I am in daily contact with the Health Directorate of the Poggioreale prison who updates me on the health treatments in progress”, the guarantor underlined. “While respecting the precautionary system in the case of serious crimes, I believe that this should be implemented through the gradation of the measure with the application of a more adequate restriction when the person involved is in precarious psycho-physical conditions, as in the case of Marandino”.
For Ciambriello, it is Article 32 of the Constitution "that defines health as a fundamental right of the individual". Therefore, "the protection of health is a supreme constitutional value of every citizen, free or otherwise free". The Neapolitan Guarantor of prisoners Pietro Ioia also intervened on the case, launching an appeal to the new Minister of Justice, Marta Cartabia.
