Pasquale Zagaria was sentenced to one year in prison for extortion, with mafia aggravation.
Another conviction, which however will not bring back to prison the criminal known as “Bin Laden” and brother of the super boss of the Casalesi Michele. Pasquale Zagaria had been released from prison after serving his sentence (he was detained under 41-bis in the Opera prison in Milan) on February 12.
The offender was sentenced with an abbreviated trial by the preliminary hearing judge of Naples Vincenzo Caputo, while five other defendants for whom the prosecution had requested a conviction were acquitted of the charge of fictitious ownership of assets with mafia aggravation, including Michele's other two brothers, Antonio and Carmine Zagaria, Carmine's wife, Tiziana Piccolo, the intermediary Luigi Diana and Marcella Meccariello.
He then declared a sentence of no case to answer for Pasquale's wife, Francesca Linetti, and Patrizia Martino, Antonio's wife, for whom the lawyers had requested a trial. Pasquale Zagaria, considered the economic mind of the Casalesi clan, was convicted of extortion committed in relation to the sale of a piece of land. According to the prosecution, the boss's brothers and wives had purchased properties at a lower price than the selling price and then registered them in the name of front men; but the preliminary hearing judge did not agree with the prosecution's approach, represented by the Naples District Anti-Mafia Directorate.
The boss will therefore not end up back in jail, after being released from prison just eleven days ago, after his lawyers Andrea Imperato and Angelo Raucci had filed a “request for continuation” and managed to obtain from the Supreme Court of Cassation the recalculation of the sentence, initially calibrated at the request of the investigating judge at 22 years. The Supreme Court of Cassation annulled the order of the investigating judge, recalculating the sentence at 19 years (which Zagaria has already spent in jail), thus reducing the sentence by 3 years.
