Free on confiscated assets, only half are reused: Naples 'black sheep'

Just over half of the assets confiscated from the mafia and reused are: this is what the report 'Fattiperbene', Libera's report against the mafia, says.

“According to a survey launched in 2019 by the National Agency on a sample of approximately 6.000 real estate assets intended for municipal administrations, from the findings received on 2.600 assets, it appears that only a little more than half of the assets were actually reused” can be read in the dossier “Fattiperbene” created by Libera on the occasion of the 25th anniversary of the approval of Law 109 of 7 March 1996 for the public and social reuse of assets confiscated from the mafia.

In total they are 6062i real estate (cadastral parcels) confiscated from 1982 to today in Campania, the 45%they were destined byNational agency for institutional and social purposes, while 55% remain still to be determined. The province of Naples is the one with the highest number of confiscated assets not yet allocated: 1849. The province of Caserta follows with 1002 and Salerno with 349 assets still to be allocated. Instead there are 913 the confiscated companies of these the 30% has already been earmarked for sale or liquidation, for rent or for management by cooperatives formed by the workers of the same; 70% is currently still managed by the Anbsc. The Province of Naples first among the regions for the number of companies destined (165) while there are 355 still under management; the province of Caserta follows with 61 companies destined and 180 still under management by the Anbsc.

36.616 properties have been confiscated from 1982 to date: 48% have been allocated by the National Agency for Seized and Confiscated Property for institutional and social purposes, but 5 out of 10 have yet to be allocated. The largest number of confiscated and allocated properties is in Sicily (6.906); followed by Calabria (2.908), Campania (2.747), Puglia (1.535) and Lombardy (1.242). There are 4.384 confiscated companies: 34% have already been earmarked for sale or liquidation, for rent or management by cooperatives formed by their workers, 66% are still managed by the National Agency. Here too, Sicily is first among the regions for the number of companies earmarked (533) ahead of Campania (283), Calabria (204) and Lazio (160).

Libera underlines "the positivity" of the path taken and "of many experiences born thanks to the presence of assets taken away from the availability of the mafia, of the various forms of economic and financial crime (from money laundering to usury, from gangmastering to eco-mafias) and corruption".

But the contribution "would certainly be greater if all assets were quickly returned to the community and social policies became a political priority in support of the rights to housing, public health, environmental sustainability, decent work and educational and cultural paths".

From the annual reports of the extraordinary government commissioners and the National Agency it is also possible to trace the historical trend of confiscations and destinations, starting from 1982. In particular, up to 1996 there were 1.263 confiscations and 34 destinations: these were the first years of application of the Rognoni-La Torre law, during which the law for social reuse was not yet in force. In the second decade, from 1996 to 2008, the numbers increased significantly and in 2001 alone there were 1.023 confiscations and 315 destinations.

In the following years up to 2019, the last year for which the Agency report is available, only the data relating to destinations is reported, 1.512 in 2019. The historical trend of the destination of registered movable assets can be traced since 1982: in the 2017-2018 report of the National Agency, in fact, it is reported that up to 2018 3.829 movable assets of different types were assigned, with the following percentages: destruction/demolition 42,07%; free loan 20,55%; sale 18,65%; assignment to law enforcement 14,60%; transfer to firefighters and public rescue 4,12%. In the dossier, Libera also mapped the experiences of reusing confiscated assets by surveying 867 different third sector entities involved in the management of assets obtained in concession from local authorities, in 17 out of 20 regions. The data collected shows that more than half of the social entities are made up of associations of various types (468) while social cooperatives are 189. Among the other third sector management entities, there are 11 amateur sports associations, 23 third sector entities that manage subsidiary welfare services in agreement with public bodies (health companies, park authorities and consortia of municipalities), 36 temporary associations of purpose or networks of associations, 60 entities from the religious world (dioceses, parishes and Caritas), 26 foundations, 14 scout groups and 6 schools of various types and levels.
