Franceschini abolishes film censorship

“Film censorship has been abolished, and that system of controls and interventions that still allowed the State to intervene in the freedom of artists has been definitively overcome”.

With the signature of the minister Dario Franceschini under the decree establishing the Commission for the classification of cinematographic works at the Directorate General for Cinema of the Ministry of Culture, the provisions of the so-called “Cinema Law” finally take shape, the one with which in November 2016 the government had redesigned its commitment to Italian cinema, including in terms of funding. The provision marked, among other things, the overcoming of the “censorship” introduced with law 161 of 1962: the controversial mechanism of ministerial commissions called to evaluate films was shelved, the government had one year to define a new classification system that would make film producers and distributors responsible: as already happens in other sectors and substantially all Western countries, the operators themselves would have to provide for defining and classifying their own films, with the State ready to intervene and sanction only in the event of abuse.

On December 7, 2017, a decree provided for the creation of a new Commission for the classification of cinematographic works and the approval of its operating regulations: while waiting for the Commission to actually be established, the seven sections of the Commission for cinematographic review ex lege 161/1962 would continue to exercise their functions by giving their opinion for the granting of the “no objection” before public screening. With the decree signed today, the Minister of Culture underlines, “that system of controls and interventions that still allowed the State to intervene on the freedom of artists is definitively overcome”. In fact, the possibility of censoring cinematographic works is shelved and there is no longer an absolute ban on theatrical release or on release conditioned by cuts or modifications.

The Commission is led by the President Emeritus of the Council of State, Alessandro Pajno, and is composed of 49 members chosen from "experts with proven professionalism and competence in the film sector and in the pedagogical-educational aspects connected to the protection of minors or in social communication, as well as designated by parents' associations and animal protection associations".
