Casal di Principe. "The demolitions of illegally built properties are the only antidote, unfortunately very little used, to the construction of new illegal houses, which continues to be a plague in our country, especially in the South. Municipalities can, by law, proceed with the acquisition of illegal properties as public property, this rule is also very little applied, thus discouraging those who count on impunity.

Situations of real need, for which the demolition of the illegal house concerns the only dwelling available for the family unit, as in the case at the center of the protest of the mayor of Casal di Principe, must be evaluated on a case-by-case basis, with the support of social services, in order to guarantee accommodation, even if temporary, to those who lived there. It is unthinkable that in the face of a serious shortage of council houses and social housing for those who cannot afford to pay rent according to market prices, such as to determine long rankings especially in metropolitan areas, which is the real emergency to be resolved, those who have decided to break the law, building an illegal house, also taking advantage of the inertia of the institutions, acquire a sort of "priority".

We believe that first of all, the rights of those who are forced to cohabit in large families because they do not have a home must be affirmed, as well as those who simply give up, for the same reasons, on building an independent life and do not take the shortcut of illegal construction, often in the hands of the mafia.

With these essential premises, Legambiente joins the request to temporarily suspend the execution of the sacrosanct order for the demolition of the illegal building issued by the judiciary, hoping that a National Plan to combat illegal building will be prepared as soon as possible, so as to support the work of the judiciary, committed to restoring legality in territories where it has been forgotten, that of the Prefectures, with the effective implementation of the rule on substitutive powers in the event of inertia of the Municipalities, of the local administrations most affected by the phenomenon of illegal bricks. Without shortcuts and more or less disguised amnesties.

The rules to address and resolve this endemic problem must be completed and strengthened, just as both the necessary resources to carry out demolitions and the obligation for the Municipalities to use them must be guaranteed.”

On a joint note Stefano Ciafani and Mariateresa Imparato respectively national president and regional president of Legambiente on the resignation of the Mayor of Casal di Principe following the failure to extend the request made to the Public Prosecutor's Office of Santa Maria Capua Vetere who ordered the demolition of an illegal house in which 4 minors live.
