Casal di Principe, the head of the Public Prosecutor's Office Maria Antonietta Troncone: "Demolition postponed for 6 months already"

Casal di Principe. This morning the bulldozers arrived, sent by the Public Prosecutor's Office of Santa Maria Capua Vetere, for the first demolitions of the two homes on Via Ancona in Casal di Principe.

The two-story illegal building is located in an area where most of the homes are illegal because they were built about 20 years ago when there were no master plans and other urban planning tools.

The protests of the residents and, above all, the extreme gesture of the mayor Renato Natale who, yesterday afternoon, presented his resignation against the choice to deny the postponement of the demolitions were in vain: "In Casal di Principe alone there are at least 1400 houses declared abusive by sentence, 300 in the nearby Municipality of Casapesenna, 1600 in San Cipriano d'Aversa, and they are almost always houses inhabited by families without means. Also in Casal di Principe, for 250 homes there is an executive order of demolition.

The Municipality is responsible for each demolition, so in addition to the housing drama there is also a problem of public resources. With the Cassa Depositi e Prestiti, we have taken out loans for 1,6 million euros for 11 demolitions; each demolition costs between 150 thousand and 200 thousand euros. If we consider that there are 250 homes in Casal di Principe for which there is an executive order to demolish, we would arrive at the figure of 35 million euros just for my Municipality; and to think that the Cassa Depositi e Prestiti has set aside 50 million for demolitions”.

At the center of the controversy was especially the person who ordered the demolition, especially after the press conference of Mayor Natale. And it is precisely to him that the head of the Public Prosecutor's Office of Santa Maria Capua Vetere Maria Antonietta Troncone wanted to respond.

“The request for postponement advanced by the mayor of the Municipality of Casal di Principe – he explains – was advanced as early as March 29, the date initially set for the execution, and resulted in the acceptance of the requests for postponement, so much so that the execution was postponed until September 2, without prejudice to the mayor's commitment to find suitable housing for the two families. Once the deadline had elapsed, the execution was set for September 2, as the demolition could not be postponed any further, also by virtue of the dangerous situations of the building, such as to compromise the physical safety of the miniati”.

Troncone also adds that "both families have found alternative housing solutions. It is issued that one of the families was already registered as a resident, since December 2020, in a home other than the one being demolished, using public housing, as reported by one of the members of the family to the judicial police. The second family reported, a few days before the execution, that they had found a solution in rented accommodation. For this reason, the conditions underlying the request for postponement appear to have ceased to exist, given that the two families have found accommodation elsewhere, a circumstance that made it possible to carry out the demolition of the building".

The illegal building is the subject of a criminal conviction by the court of Santa Maria Capua Vetere, Aversa branch, which became final on 6 July 2005, which contains the judicial order for the demolition of the illegal building owned by IA, as it does not have any urban planning permits and is therefore devoid of any type of structural or building project, as well as a certificate of habitability, with reference to the current legislation in the matter, including health legislation.

The building, built in the agricultural zone 'E1', is composed of three levels above ground, for a volume of approximately 2370 cubic meters "which highlights that it is not a construction for residential needs" the Prosecutor's Office underlines in a note. The entire building was built "without any criteria of seismic regularity and appears to be lacking seismic testing, as the required filing of the project documents at the competent One-Stop Shop for Construction Office was not carried out".

The area where it was built is covered by several restrictions: seismic, agricultural and unbuildable by the municipal master plan. "Furthermore, the building - continues the Prosecutor's Office - presents several situations of additional danger, such as the absence of handrails and parapets on the stairs, currently in their raw state, for access to the apartments, with an evident and concrete danger of falling from above. The electrical system also presents high criticalities, as there are numerous flying electrical wires in the illegal structure".

In these hours Marisa Diana, Councilor for Education of the Municipality of Casal di Principe, is working with the outgoing Mayor Natale to try to find accommodation for the two families. "The house has been demolished - she said - now we expect answers from the inter-ministerial table convened by Minister Mara Carfagna". One of the two families has reportedly found temporary accommodation in a council house of some relatives who died a few months ago from Covid, while for the second, the Diocese of Aversa, through the vicar Don Franco Picone, has made accommodation available in the parish of San Nicola di Bari and has offered, as an alternative, to find an apartment with rent paid by the Curia.
