Caserta. Soldiers belonging to the Caserta Forestry Carabinieri Station have executed the Order of preventive seizure of an area affected by the illicit disposal of special waste and of a truck owned by a gardening company in Caserta, issued, at the request of the Public Prosecutor's Office, by the GIP at the Court of Santa Maria Capua Vetere, against the legal representative of a gardening company in Caserta Capital.
The investigation was inspired by a complaint filed with the aforementioned Forestry Department in which it was reported that the driver of a lorry had illegally disposed of the transported load, consisting of non-hazardous special waste from gardening work, along the roadside of via Maria Sofia di Baviera, in the locality “Masseria Ferrara”, in the municipality of Caserta, within a wooded area of Monte Tifata.
The subsequent investigations made it possible to trace both the area in which the special vegetable waste had been illegally disposed of on the ground and to identify the owner of the Fiat Iveco brand lorry, equipped with a tipper, involved in the affair, which turned out to be the property of the owner of a gardening company in Caserta duly registered in the Chamber of Commerce's business register (activity code: care and maintenance of the landscape - including parks, gardens and flowerbeds).
The crimes of illicit disposal of non-hazardous special waste and alteration and disfigurement of the natural habitats of the places were found against the owner of the gardening company as the waste was spilled within a wooded area included in the areas Natura 2000 Network (Site of Community Interest “Monte Tifata” – Code IT8010016).
During the seizure operations of the truck, the owner of the gardening company was also administratively sanctioned, for an amount of €3100, as the body of the aforementioned truck was found containing non-hazardous special waste coming from gardening operations in the absence of the Waste Identification Form that allows documenting the traceability of the same.
