The party of Matteo Salvini will be out of the electoral race in Naples on October 3 and 4.
Il Council of State has in fact rejected the appeal presented by the list First Naples, linked to the Carroccio that had chosen to run alongside the mayoral candidate Catello Maresca without a symbol, confirming the decision of the TAR of Campania that four days ago had excluded her, after the decision in this sense of the prefectural commission, which had excluded four lists of the centre-right.
In addition to Prima Napoli, the Council of State also rejected the appeals of the civic list Catello Maresca Mayor, another excluded by the TAR and the prefectural commission, and that of the animalist party created by Marcello Taglialatela, former parliamentarian, always in support of Maresca.
“The Prima Napoli List of candidates for the office of president and 21 candidates for the office of councilors of the Second Municipality, from the elections of the mayor and the city council of Naples which will take place on October 3 and 4, 2021 – write the judges of the Council of State, Giancarlo Luzzatti and Diego Sabatino – due to the receipt at the competent municipal offices, after the deadline set for 12.01 on 4 September 2021 and considering this delay, in itself, a sufficient element to determine the rejection of the list in the absence of the specific circumstances specified by jurisprudence, and the absence, among the documentation filed, of the declaration of connection of the delegates of the list with the candidate mayor, of the list symbol and of the budget estimate of the expenses for the electoral campaign”,
is excluded from the electoral competition. The same reasons also apply to that of Catello Maresca Mayor and the animalist Movimento a Quattro Zampe. Faced with the first appeal, the TAR had held that “failure to present the electoral badge is sufficient to justify exclusion”.
The further appeal to the Council of State is considered unfounded because “for municipalities with more than ten thousand inhabitants, the presentation of a list symbol, even a figurative one, is mandatory, and the list must also be accompanied by a model of the symbol deposited by hand on digital media or in triplicate in paper form”.
Both rules, specifies the Council of State, must therefore be interpreted in the sense of the mandatory requirement for the permit. We are still waiting for the decision on a second civic list of Maresca, the one called Catello Maresca.
