Antonio and Giovanni Carfora, in turn sons of the boss Nicola Carfora known as o fuoco, a former ruthless killer of the clan of Umberto Mario Learned, defended by the lawyer Antonio Di Martino, according to the DDA investigators, shot Pennino to avenge their cousin Nicholas, together with two other relatives, Giovanni Amendola and Lello Iovine (defended by lawyers Raffaele Chiummariello and Alfonso Piscino), relatives of the Carforas, also sentenced by the judge for the same crime, but to seven years and ten months of imprisonment.
The judge did not consider the aggravating circumstances of abject and futile motives and the aggravating circumstance of having committed the attempted murder at night to be existent, while he recognized the reduction of the compensation for damages.
