The premier Mario Draghi extends the obligation to over a third of Italians. With a crackdown accompanied by checks and sanctions, but only for the purpose - he explains to his ministers - of “continue to open the country” and avoid new closures. Workers, but also mayors, governors, and institutional leaders, are given a month to comply, with the first dose of the vaccine. Then, from mid-October, to access the workplace if they are not vaccinated or recovered from Covid, they will have to take a swab every 48 hours (72 hours if molecular), otherwise they will incur suspension from work or salary and fines of up to 1500 euros.
Mandatory Green Pass for All Workers
The Green Pass will be mandatory for 23 million workers. And the Minister of Health Roberto Speranza announces that “tests will be free only for those exempt. Antigen tests will be free only for those exempt as per the circular from the Ministry of Health”, said Minister Speranza in a press conference after the green light from the Council of Ministers to the new decree law for the extension of the Green Pass to all workplaces.
With the approved decree, he explained Hope, “we will also make the network of pharmacies active and capable of administering swabs, rapid antigen tests in our country more widespread. We will do this with a rule that requires all pharmacies that have the requirements to be able to perform swabs to respect the memorandum of understanding that Commissioner Figliuolo signed with the organizations representing pharmacists”.

Green pass, Cdm note: salary stop from day one
“Payment is not due from the first day of absence”. This is specified in an update published a few minutes ago of the press release of the Council of Ministers on the Green Pass obligation. The salary freeze, explains the note, starts from the first day for public and private sector workers who do not have the green certificate. In the public sector, those who do not have a Green Pass are considered “absent without justification” and after the fifth day of absence the employment relationship is suspended. In the private sector, however, the worker is absent without the right to pay until the pass is presented. No disciplinary consequences and no dismissals, in both cases.
Certified immediately after first dose
Wherever it is possible to control, the obligation comes into force. Therefore, Brunetta explains, not on local transport, for example. The only limit the government encounters is in the constitutional bodies, the Quirinale, the Chambers and the Constitutional Court, which have autodichia, that is, they govern themselves, and therefore are invited to adapt (in a draft the deadline of October 15 appeared, then it disappears).
In Parliament, however, the debate opens: the Lega Nord rebellion led by Claudio Borghi says no. As for sanctions, it will not be possible to get to the dismissal of the worker. In the public sector, the suspension of the salary will arrive after 5 days without Green pass, in the private sector from the first day. And then for the lack of controls by employers, fines from 400 to 1000 euros, for violations by workers from 600 to 1500 euros.

Magistrates and employees of the Bank of Italy, domestic workers, carers, electricians and plumbers, ministerial and municipal council employees, governors and regional councillors elected in elections, volunteers: from 15 October until 31 December, when the state of emergency is scheduled to expire, the green pass becomes mandatory in all workplaces and will directly impact the lives of 23 million Italians, of whom 14 million and 700 thousand are employed in the private sector. Including deputies and senators, although, since the Chamber and Senate are constitutional bodies, it will be up to them to decide when and with what methods to adapt their system based on the principle of autodichia, or autonomous decision-making.
OBLIGATION FOR ALL WORKERS
The decree, 9 articles in the latest draft, first of all introduces the obligation for all public employees: "personnel of public administrations, independent administrative authorities, including Consob and the Pension Fund Supervisory Commission, the Bank of Italy, as well as public economic entities and bodies of constitutional importance" as well as all "holders of elective offices or top institutional positions". And also to all those individuals who, "in any capacity" carry out their work activity in a public administration, even with external contracts. The rule also applies to constitutional bodies - Presidency of the Republic, Chamber of Deputies, Senate, Constitutional Court - but it will be up to them to define how to apply it. The same goes for the private sector: "anyone who carries out a work activity" to access the workplace is required to "possess and show the certification". In both the public and private sectors, all those who are exempt from the vaccination campaign will not have to show the green pass.
GREEN PASS ALSO IN COURTS BUT NOT FOR LAWYERS
The decree also introduces an ad hoc rule for access to courts and judicial offices: ordinary, administrative, accounting, military and honorary magistrates, lawyers and state attorneys and members of tax commissions will have to have the green pass. The rule will not apply to lawyers, however: the provisions, the decree says, “do not apply to lawyers and other defenders, consultants, experts and other auxiliaries of the magistrate outside the administration of justice, witnesses and parties to the trial”. A lawyer will therefore be able to go to court without having the certificate but, for example, will have to show it to enter a law firm.

In order not to further penalize those who do not want or cannot get vaccinated, the decree introduces swabs at a controlled price for everyone in pharmacies that have joined the memorandum of understanding: free for those who cannot get vaccinated, 8 euros for minors and 15 euros for everyone else. The draft provides for a fine of between one thousand and ten thousand euros for pharmacies that do not respect the prices and the prefect may also order the closure of the business for 10 days.
GREEN PASS VALID FOR 72 HOURS
As regards swabs, with an amendment to the green pass bis decree, the validity of the molecular results has also been extended to 72 hours while that of the antigenic ones will continue to be 48 hours.
CHECKS ON EMPLOYERS, INCLUDING SAMPLE CHECKS
The government has established that employers, both in the public and private sectors, will have to verify whether workers have a green pass. They will also have the task of defining, by October 15, the “operational methods for organizing checks,” which may also be random. There will have to be a person in charge of the checks, which, as a priority, must be carried out at the time of access. The validity of the green pass can be verified, in the private sector, with the “VerifiCa19” app, while in the public sector the prime minister, on the proposal of the ministers for public administration and health, will be able to define guidelines “for the homogeneous definition of organizational methods.”
FINES UP TO 1.500 EURO AND SALARY SUSPENSION
For those who do not have a pass, a series of sanctions are foreseen: in the public sector, after 5 days of unjustified absence, the suspension of the employment relationship and therefore of the salary will be triggered, while in the private sector the suspension will be immediate. In any case, the decree specifies, “without disciplinary consequences and with the right to maintain the employment relationship”.

Employers who do not carry out checks are also subject to fines ranging from 400 to 600 euros, while public, private and self-employed employees who are caught in a workplace without a pass risk a fine ranging from 1.500 to XNUMX euros.
