Businesses, Castelli: 'DL crisis' signal to entrepreneurs, other measures ready

President De Lise: “Professionals become value, now we need more responsibility”

“At the end of 2020, 26% more companies were expected to be insolvent. A frightening figure that made us introduce rules to support businesses, but also provisions that gave those in crisis more time to reorganize. This is how the great work on the 'Business Crisis' Decree was born. What has been done to date represents the first step in a much more ambitious project, now other measures will need to be introduced quickly, such as re-shoring or further initiatives to encourage the internationalization of our businesses”.

The Deputy Minister of Economy and Finance said this, Laura Castelli, during the conference “Prevention and management of the crisis: a new business culture”, organized by the National Union of Young Chartered Accountants and Accounting Experts with Ugdcec of Benevento, Odcec Benevento and Fondazione Centro Studi Ungdcec, and the patronage of the University of Sannio and the Municipality of Benevento.

"The 'Crisis Decree'' – highlighted Matteo De Lise, president of Ungdcec – fprovides entrepreneurs in difficulty with additional tools for the recovery of businesses that risk exiting the market. The preventive phase of the business crisis, which is the most important, finally becomes central. It is a reform - he added - that will also give dignity to all parties involved in the business crisis, I am thinking of the Board of Auditors and the Supervisory Bodies: the accountant will no longer be seen as a cost but as a value. The task of professionals will now be to be ready, to be responsible and to give the right weight to the hours of work that will be carried out".

According to Carlo De Luca (member of the Ungdcec national board) "the world has changed and will change further. Today it is difficult to use essential services, schools and universities have been overwhelmed by the pandemic, not to mention businesses. Accountants - he points out - are asking that in the coming weeks there is no further tax for professionals and that previous training is recognized, it is an essential step in this historical moment".

The mayor of Benevento and former minister, Clement Mastella, for his part, stressed that "the crisis today closely concerns local authorities: it is difficult to guarantee services, there is a lack of funds but above all a lack of qualified personnel, it is difficult to think of intercepting European resources in these conditions. Furthermore, we cannot think of having already emerged from the pandemic: difficult months still await us".

Marilisa Rinaldi, president of the Court of Benevento, observed that “with the implementation of Legislative Decree 118/2021, a change in mentality will also be needed for judges, who will have to be increasingly specialized. A specialized judge could better accompany the entrepreneur in overcoming the crisis, speeding up the times and providing effective responses”.

Per Michele Monteleone, delegated judge of the Bankruptcy Section at the Court of Benevento: "The crisis has gripped the country for too many years, conditioning the work of professionals and forcing the legislator to continuously intervene. But the term crisis often also travels with 'opportunity': comparison, growth and the desire to give voice to all the components can allow us to arrive at shared solutions that allow us to build a new economic fabric".

The conference was also attended by Domenico D'Agostino (president of Ugdcec) Benevento; Ida Lonardo (regional coordinator Ungdcec Campania and Molise) and Gerardo Canfora (rector of the University of Sannio).

The first session, moderated by Fabrizio Russo (president of Odcec Benevento), developed on the theme of “Organizational structures, crisis detection and alert procedures”, with the contribution of Stefania Pacchi (professor at the Carlos III University of Madrid) and Giuseppe Fauceglia (professor at the University of Salerno).

The second session, moderated by Michele Cuoco (magistrate at the Court of Benevento), focused on the importance of crisis indicators and the responsibility of corporate bodies in the renewed regulatory framework, was attended by Francesco Puccio (president of the Fondazione Centro Studi Ungdcec) and Nicola Graziano (judge delegate at the Court of Naples).

A round table discussion followed on the topic of “The business crisis seen by professionals between obligations and opportunities”, with Pietro Paolo Papaleo (chartered accountant); Paolo Florio (councillor of the Fondazione Centro Studi Ungdcec); Marco Pugliese (judge of the Bankruptcy Section at the Court of Naples); Manlio Lubrano di Scorpaniello (lecturer at the University of Sannio) and the lawyer Augusta Dramisino.
