Teacher cuts student's hair in class: Father seeks $1 million in damages
One million dollars in damages, that's what Jimmy Hoffmeyer, father of a 7-year-old student at Ganiard Elementary School in Mount Pleasant, Michigan, is asking from a school.
A teacher, without parental permission, cut her daughter Jurnee's hair in class. The father claims the mixed-race girl's constitutional rights were violated and accuses the teacher of racial discrimination, ethnic intimidation, intentional infliction of emotional distress, assault and battery.
The facts date back to March, when Jimmy Hoffmeyer's daughter, on the school bus, was cut off by a classmate on one side of her head. When she returned home from school in that condition, Jurnee was taken by her family to a hairdresser who gave her an asymmetrical cut to make the different lengths less obvious. The parent's complaints reached the principal.
Two days later, Jurnee came home from school with her hair cut on the other side of her head. But this time it wasn't a classmate's spite.
The teacher, on her own initiative, had cut her hair “to make it uniform,” as she justified herself when the case broke. The school intervened, reprimanding the teacher, but leaving her in her position. Not satisfied with this, father Hoffmeyer, who is banking on the skin difference between his daughter, a black woman, and the white teacher, filed a lawsuit in federal court in western Michigan against the school, which, as he claims, “failed to adequately train, monitor, direct, discipline and supervise its employees.” In the meantime, Jurnee has started attending another school.
