Scafati. Sentenced to 11 years in the first instance because accused of being the instigator of an attempted murder: the well-known criminal from the Mariconda neighborhood was acquitted on appeal, Enrico Berritto.
He was kidnapped, beaten and then thrown from the balcony of a building in Mariconda district: Enrico Berritto, a well-known face to the police, had been sentenced to 11 years in prison in the first instance on charges of attempted murder, as a result of the sentence of court of Nocera Inferiore.
The facts date back to 18 2009 February, when a group of four people – never identified – kidnapped MM, 37 year old from Angri, became the target of a violent beating with clubs and sticks. The man woke up in the arms of his attackers in the stairwell of a building in Scafati, on the second floor. He was grabbed again with force - according to the victim's testimony - because the plan was to take him to the highest floor, and then throw him downstairs.
Behind that gesture, a sentimental relationship that the Angrese would have entertained with the defendant's partner. The victim had to pay with his life. In the first degree Enrico Berritto was condemned to be the instigator of the attempted murder.
On appeal, his defense attorney, thelawyer Gennaro DeGennaro after a several-hour long speech, he managed to overturn the long-standing litigation. The prosecutor had asked for the 11-year prison sentence to be confirmed because the contested facts demonstrated the ferocity of the murder plan that had been pre-planned to harm the poor victim.
No benefit was to be recognized to the defendant. Berritto's defense was able to demonstrate that the defendant was not involved in the murder warrant. The appeal trial ended, miraculously, with acquittal sentenceBerritto was pardoned and that extreme gesture, to this day, has no one responsible.
