The third section of the Court of Assizes of Appeal of Naples has reduced the sentence imposed on Giuseppe, for unintentional homicide, from eight years and two months to six years of imprisonment. The second-instance sentence with which on 15 July 2019 the defendant, defended by the lawyers Raffaele Chiummariello and Nicola Pomponio, was sentenced to 8 years and 2 months, was annulled last 17 February by the first section of the Court of Cassation.
The judges of the Supreme Court, after having rejected the appeal presented by the deputy attorney general of Naples (who asked for 20 years), and excluded voluntary homicide, sent the trial back to another section of the Court of Assizes of Appeal. In Mugnano, that tragic night in September, Varriale, after yet another argument with his ex, got into his car and drove off, accelerating sharply, but Alessandra, in the meantime, had clung to his car in a last-ditch attempt to stop him.
She fell violently to the ground, after being dragged, reporting serious injuries that caused her death, a few hours later, in hospital. Varriale, in the first instance, was sentenced to 4 years and 8 months for road homicide.
