Customs officials continue to fight illegal trade in the port of Naples where inspectors seized 600 vinyl gloves
Failure to comply with a provision legally given by the Authority, sale or otherwise placing into circulation of industrial products, with national or foreign trademarks or distinctive signs capable of misleading the buyer about the quality of the product, aggravated smuggling, are the hypotheses of crime contested to the legal representative of a company for having placed on the market or otherwise into circulation a batch of 599.595 Personal Protective Equipment consisting of vinyl gloves of Chinese origin, bearing the CE marking, without suitable certification proving compliance with the requirements set out in Regulation (EU) 2016/425, for which exemption from VAT payment had been requested pursuant to art. 124 of Legislative Decree 34/2020. The consignment of gloves, originally consisting of 700.000 units, had been intercepted by officials of the Naples 1 Customs Office who had suspended its release, entrusting it, with a ban on marketing, to the representative of the importing company pending the determinations of the MISE pursuant to Regulation (EC) no. 765/2008. Having acquired the provision of the Market Surveillance Authority, the importing company declared that it wanted to proceed with the destruction of the non-compliant load.
As reported by the DIRE agency, after several unsuccessful requests from customs to destroy the goods, given the passage of the established time and the silence of the importer, officials from the Naples 1 Customs Office, suspecting that the goods had been put into circulation fraudulently, conducted a raid at the place where the cargo was stored and found that 599.595 vinyl gloves had disappeared.
Once the crimes hypothesized above had been committed, the Customs Officials, in their capacity as Judicial and Tax Police Officers, drew up a specific communication of the crime and seized the remaining part of the goods still lying in storage.
