Naples. Discovered a massive tax evasion by a company operating in the plastic and paper sector.
Under the direction of the Public Prosecutor's Office of Naples, the Finance Police of the Provincial Command of Naples executed a preventive seizure order for the equivalent of approximately 15 million euros, against a company based in the Neapolitan city, its legal representative and its de facto administrator.
According to the reconstruction by the specialists of the Economic and Financial Police Unit during a complex judicial police investigation, the company in question, operating in the wholesale trade of plastic materials, is said to have committed a series of tax crimes for a total of approximately 15 million euros of tax evasion.
In fact, following the investigations, the company turned out to be a mere “shell company” that acted as a “missing trader” within a larger “carousel fraud”. In particular, the company, on behalf of several Italian companies, purchased plastic material without VAT from a European supplier, to then resell it with the indication of the tax on the invoice to companies established in the national territory. In reality, the sale of the goods being marketed was fictitious since the goods coming from abroad never passed through the warehouses of the “shell company”.
The data processing and the analysis of the collected documentation allowed to consolidate the hypothesis that through a false temporal representation of the individual commercial operations, it was always the final companies, beneficiaries of the fraud, that financed the purchase from the reference community suppliers, anticipating, contrary to any common and ordinary commercial practice, the sums owed by the paper company. The latter, having been created ad hoc, systematically then failed to declare the invoiced sales to the recipient companies and, in any case, always resulted in default of the tax obligation.
In light of the multiple tax violations, the Public Prosecutor's Office of Naples requested and obtained a seizure order from the GIP of the Court of Naples up to approximately 15 million euros, which allowed the financial resources, as well as movable and immovable assets available to the suspects, to be placed under precautionary constraint.
