Deiulemar Crash: Reduced Sentences for Shipowners Pasquale and Micaela Della Gatta of Torre del Greco.
The Court of Appeal of Rome – third section – called to rule for the second time after the annulment with referral ordered by the Court of Cassation of the first appeal sentence, has in fact re-determined the sentence at five years and nine months for Pasquale and Angelo and at four years and five months for Micaela.
In the first instance, the three entrepreneur brothers had been sentenced to 17 years of imprisonment, then the sentence was partially confirmed on appeal with a reduction to 13 years.
The Court of Cassation instead annulled it with a referral to a different section of the Court of Appeal, which significantly reduced the sentence.
The other defendant Giuseppe Lembo died during the trial, while for the defendant Giovanna Iuliano the Court of Appeal postponed the decision to November 9 due to health problems, excluding the relative position.
According to the prosecution, the Della Gatta brothers – defended by lawyers Mario Griffo and Giro Pasquale Sepe – emptied the shipping company of all its financial resources, taking them abroad through trusts and fiduciaries.
The three shipowners also issued bonds to finance themselves on the market; Consob authorized them to issue bonds up to a maximum of 40 million euros, but the bonds issued were of a much higher value, and in the end, when bankruptcy came, thousands of bondholders were left with nothing in their hands. The three brothers also ended up in prison for the Deiulemar collapse, where they spent sixteen months and were released when the terms of pre-trial detention expired.
