The criminal trial before the first criminal section of the Court of Santa Maria Capua Vetere (president Dr. Sergio Enea) against the former mayor Gerardo Massaro and political exponents of the old administration of the Municipality of Portico di Caserta, of two traffic policemen, a surveyor, a municipal manager and other people.
They are all accused of having perverted their public function. “to the pursuit of private interests consisting of political-electoral advantages, maintenance of positions of power, economic advantages for themselves and for subjects linked to them by political proximity”, harming those who hindered them, including municipal employees, who would have been “permanently placed in conditions of marginalization, disadvantaged, damaged and unjustly penalized”.
Today the Commander of the Carabinieri Station of Macerata Campania appeared before the Court Marshal Sparaco who reported on the judicial police activities carried out. The facts date back to 2014-2015 when the Massaro administration was in office.
It's all about a change of intended use (from commercial to residential) of a mega building complex built in the Municipality of Portico di Caserta byentrepreneur of Marcianise, Happy Letizia.
According to the reconstruction of the Public Prosecutor, the the measure would be illegitimate and it would have been issued with the sole purpose of favoring the builder since the conditions for the concession were missing (this is why the person in charge of the technical area at the time and the related manager ended up on trial) and then a series of forgeries would have been committed in the various inspections carried out both at the building complex and at the sports field.
For this story, the Public minister – who sees in the behaviour of the suspects the moves of an association to outline – contested the crimes of abuse of office and false and then also challenged the decision rejecting his request for the seizure of the fuel distributor of the former Mayor Massaro as well as the entire building complex of the entrepreneur Felice Letizia.
The defense team includes, among others, lawyers Enzo Domenico Spina, Renato Jappelli, Francesco Piccirillo, Mauro Iodice, Stefano Vaiano and Raffaele Crisileo. The Municipality of Portico di Caserta has joined the civil action with the lawyer Massimiliano Di Fuccia.
