The former administrative director of the hospital of Naples waived the statute of limitations and was acquitted by the court of Naples for not having committed the crime. Caserta Domenico Ovaiolo, who was charged with bid-rigging in connection with the awarding of a contract by the Caserta hospital in December 2012, also escaped unharmed from the trial, namely Vincenzo and Rosario Dell'Accio and Nicola Tufarelli, whose charges were subject to the statute of limitations.
Ovaiolo was put on trial for signing the assignment resolution, dated December 12, 2012, together with the then general director of the Caserta hospital, Francesco Bottino, whose case was dismissed, and the then medical director, Diego Paternosto, who was never investigated in the proceedings.

Ovaiolo's defense (lawyers Elena Lepre, Stefano Montone, and Paolo Di Furia) demonstrated, however, that the defendant had no role in the procurement process, having taken up office as administrative director on December 2012, XNUMX, just days before the resolution was issued, and that his signature therefore merely implied formal review of the document. Furthermore, the charge of interference is integrated into the case of an unlawful agreement aimed at rigging the tender, a circumstance that the trial investigation did not reveal against Ovaiolo. Therefore, the Naples panel of judges decided to fully acquit him on the merits.
