According to data from the Department for Penitentiary Administration updated to 30 June 2022, there are 54.841 people detained in penal institutions, compared to a regulatory capacity of 50.900 places, with an official overcrowding rate of 107,7%.
The figure, according to the Antigone association, is higher. After having analyzed the institutes' files penitentiaries Italians, published by the Ministry of Justice, in its report on detention conditions, Antigone explains that there are currently 3.665 unavailable places on the national territory. The effective capacity therefore drops to 47.235 places and the effective overcrowding rises to 112%.
Furthermore, 25 institutions have a real overcrowding rate higher than 150%, with peaks of over 190%. In addition to these borderline cases, there are 49 penitentiary institutions whose real overcrowding rate is between 100 and 120%, 56 in the 120-150% range. Among the most critical cases, reported by the association, are the institutions of Latina, with a real overcrowding rate of 194,5%; Milan San Vittore, which with 255 unavailable places has a overcrowding rate of 190,1%; Busto Arsizio at 174,7%.
At the regional level, the highest rate is found in Lombardy (148,9%), which is also the region with the most prisoners, 7.962, followed by Campania (6.726), Sicily (5.955), Lazio (5.667) and Piedmont (4.015). According to data from the Council of Europe, Italy is second only to Romania, Greece, Cyprus and Belgium, while the EU average is 92%.
