Il Tar of Campania ha canceled il vote a Napoli a seat, 309, For the Second Municipality with administrative of the 2021 (Lawyer, Montecalvario, Pendino – Porto, San Giuseppe) due to defects in illegitimacy of the documents relating to the voting operations.

In particular, the vote was cancelled in that section for “the failure to certify the number of authenticated and unused ballots, and the consequent lack of certainty of the correspondence between the total number of such ballots and the number of voters registered in the Section entitled to vote”, we read in judgment. The lack of regularity would have led, he continues, “to the same regularity of the preferences attributed to the candidate elected in the same List no. 7, who would have obtained only two more votes overall than those assigned to the appellant, first of the non-elected”.

The ruling refers to the list “Azzurri – We South – Napoli Viva” which belongs to Italy Viva in which Davide Esposito, who filed the appeal, obtained two votes less than a candidate from the same list. “Considering that, due to the substantial nature of the defect ascertained during the preliminary investigation, it is therefore necessary - it is read - to order the cancellation of the operations carried out in polling station 309 of the municipality in dispute and of the related minutes of proclamation of the elected officials, with consequent renewal of the electoral consultations limited to that polling station, in order to proceed with the subsequent proclamation of the elected officials in the Municipality”. The TAR therefore decides to annul the vote carried out in polling station 309 and also the minutes of the proclamation of the elected representatives and orders that the electoral operations be renewed in the same section.
