The 61-year-old Caserta native GF, who on 3 August 2021, while driving in via Brugnano, was sent to trial for road homicide Orta di Atella, hit and killed two cousins who were cycling to work. They are Salif and Moctar Sare, aged 43 and 51, originally from Burkina Faso and resident in Succivo.
The relatives of the two victims have relied on Giesse Risarcimento Danni, a group specializing in fatal road accidents, to clarify the cause of the accident and have joined the civil action with the lawyer Norberto Quieti.
"The accident occurred on a straight road where visibility was good and the two cousins were driving in single file," explains Fernando Rosa, head of the Giesse office in Monza. "The driver, who was also driving with his seatbelt unfastened, was going at a speed of over 76 km/h, well above the speed limit for that stretch of road, which is 50 km/h. In one fell swoop he took the lives of two people, leaving the Sare family and an entire community in pain."

The technical consultant of the prosecutor highlighted the responsibility of the driver: «In daytime visibility conditions, on a straight, flat stretch of road with an open view, imprudently travelling at a speed of approximately 26-29 km/h over the limit, he negligently did not notice the presence of two bicycles that were being hit from behind».
Had the driver complied with the speed limits set by the Highway Code for that stretch of road, he would have been able to brake in time: "Our consultant, as well as the prosecutor's, found that when the driver "perceived" the presence of the two cyclists, they were still no less than 20-30 meters away from the car," adds Fernando Rosa of Giesse Risarcimento Danni. "At a speed of 50 km/h, all other conditions being equal, this distance would have allowed the driver to avoid the accident and stop his vehicle before impacting the cyclists."
The judge accepted the prosecutor's request and sent the driver to trial, setting the start of the trial for the hearing on January 19, 2023 before the Court of Naples North.
