"Income is something different from gambling" and therefore the fact does not exist. With this motivation the court of Avellino acquitted a 37-year-old resident of the Irpinia capital who had been receiving citizen's income since 2019 despite having moved a sum of three hundred thousand euros with prepaid cards in the same year on all types of bets and online games.
The avid gambler, who in the meantime replayed and lost all the sums she had won, had simultaneously received 12.600 euros from INPS. The thesis supported by the lawyer Danilo Iacobacci, the woman's defender, according to which the winnings from games do not constitute income was accepted by the judging panel presided over by Sonia Matarazzo, with Pierpaolo Calabrese and Michela Eligiato on the sides, who acquitted the defendant of the crime of fraudulent acquisition of public funds.
The restitution, as requested by INPS, of the sums received with the citizen's income remains in question. Strengthened by the ruling of the judges of Avellino, the woman, defended in civil proceedings by the lawyer Fabiola De Stefano, has filed an opposition.
