Smartwatch equals smartphone in terms of betrayal. This is established by a ruling of the Court of Benevento, released by the Cataldi studio, which denies the violation of privacy invoked by the reporter.

The context is that of a hot summer. Overheated, the man decides to take off his smartwatch and leaves it on the nightstand. However, the device is connected to the smartphone and, through the parallel connection between the two devices, the wife discovers the betrayal revealed by the 'classic' messages with the lover.

While dusting the nightstand, the woman sees the clock flashing with the arrival of notifications. She reads the texts with unmistakable content and photographs them with her cell phone. She also discovers that her husband has rented a garconniere to meet with his lover and initiates the separation.

The Court of Benevento, first civil section, with a sentence pronounced in recent days, charges the man with the reasons for the separation, rejecting his disavowal of the photos of the messages and the invocation of the violation of privacy. According to the judge, the disavowal must be timely, clear, detailed and explicit, as well as supported by elements that demonstrate that the reality reproduced does not correspond to that of the facts.

As far as privacy is concerned, the court finds no violation since the characterizing element of an image is its object. There is no difference between a photo of a screen and one that portrays people in affectionate attitudes.
