The Court of Appeal of Rome, before which the second-instance trial is pending, having heard the request to replace the precautionary measure of imprisonment with that of house arrest, on 15 December 2022, accepted the defense complaints proposed by the lawyers Vincenzo Esposito and Cesare Placanica, ordering the replacement of the measure for Giovanni Giugliano.
In the first instance he had been sentenced to 9 years of imprisonment, in conjunction with other defendants, for various charges of extortion, self-laundering and usury, all aggravated by art. 416 bis 1 of the penal code.
The defense team highlighted how the precautionary framework had already undergone a significant change as a result of the annulment during the re-examination, also on the basis of the provisions of the Supreme Court of Cassation, of some contested hypotheses of self-laundering, extortion and the aggravating circumstance of art. 416 bis 1 cp. The precautionary requirements were further weakened by the trial phase where the position of the defendant Giugliano Giovanni was clarified.
After the first degree trial, all the defendants filed an appeal. The evidence acquired during the trial allowed a precautionary turn for many positions with the replacement of the measure originally applied.
Following the “Family Affairs” investigation into the Senese clan, led by the Public Prosecutor of the DDA, in July 2020 the military of the Special Currency Police Unit of the Guardia di Finanza and personnel of the Rome Flying Squad, with the support of other operational units of the Corps and the State Police, executed an order applying precautionary measures issued by the GIP of the Court of Rome, against 28 people and a preventive seizure of assets for approximately 15 million euros.
The crimes contested, in various capacities and in conjunction, are those of extortion, usury, fraudulent transfer of values, money laundering, self-laundering and reinvestment of illicit proceeds, with the aggravating circumstance of having acted with mafia methods, facilitating the criminal galaxy of the Campania Camorra which, from its land of origin, has relocated, starting in the 1980s, also to Lazio and other Italian regions.
