Sentences confirmed for six defendants, the offence was downgraded and the statute of limitations expired for two others, and one was acquitted: this concludes the second-degree trial held in Naples regarding the bankruptcy of "Cammo" di Morcone, a cooperative in the province of Benevento.
In the first instance, on 18 February 2020, the Court of Benevento had convicted the directors Nicola Parcesepe, Guglielmo Fusco, Antonio Parlapiano and Pasquale Rinaldi as well as the members of the board of auditors Antonella Di Mella, Tommaso De Capua, Antonella Gramazio for bankruptcy for complicity through omission in bankruptcy.
Yesterday, the third section of the Court of Appeal of Naples acquitted Gramazio, defended by the lawyer Giuseppe Maturo of Benevento, for not having committed the crime. The Judge recognized that, in her capacity as a member of the board of auditors, she intervened after the insolvency and for this reason she was not involved in the facts contested by the investigators.
For Di Mella, defended by the lawyer Andrea De Longis of Benevento and for De Capua, defended by the lawyer Antonio Barbieri of the Aricò firm of Rome, any hypothesis of complicity through wilful omission in the bankruptcy attributed to the directors was excluded and therefore a hypothesis of simple culpable bankruptcy with a declaration of prescription of the crime was considered.
The sentence for the remaining defendants was confirmed. “We are waiting to read the motivation – commented the lawyer Antonio Barbieri – but in the meantime we note that any hypothesis of fraudulent conduct by the members of the board of auditors, who have always operated with correctness and linearity, has been excluded".
